Hunter Biden Wins $1.7 Million in Punitive Damages in Defamation Case Against Former Overstock CEO

A federal judge in Los Angeles has awarded Hunter Biden $1.7 million in punitive damages in his defamation lawsuit against the former CEO of Overstock.com and prominent promoter of 2020 election conspiracy theories, Patrick Byrne.U.S. District Judge Stephen Wilson of the Central District of California issued the ruling on Friday, after Mr. Byrne repeatedly defied court orders and failed to defend himself against Mr. Biden’s claims. The lawsuit, filed in November 2023, centered on claims Mr. Byrne made in a June 2023 interview published by Capitol Times Magazine, in which he alleged that Mr. Biden had solicited an $800 million bribe from Iran in exchange for his father’s administration unfreezing $8 billion in Iranian assets and softening its position in nuclear negotiations. Mr. Byrne repeated the allegations on social media on October 8, 2023 — the day after Hamas’ deadly attacks on Israel.“The clear implication of Byrne’s October 8, 2023 posts was that Plaintiff’s allegedly criminal and corrupt actions had contributed to the terrorist attacks by Hamas,” Mr. Biden’s complaint said.In his ruling, Judge Wilson found that Mr. Byrne had not only failed to substantiate his claims but had continued to spread them even after litigation began.“Here, the evidence is clear and convincing that defendant has engaged in intentional misrepresentation with conscious disregard towards plaintiff’s rights,” Judge Wilson wrote. “Defendant’s defamation went far beyond mere negligence. In fact, defendant has admitted that after the offending article was published, defendant repeatedly reposted the article across social media platforms and encouraged his followers on those platforms to promote it further,” the judge wrote.Judge Wilson, a Ronald Reagan appointee, also cited Mr. Byrne’s persistent attempts to delay proceedings — including firing his legal team on the first day of trial in July 2025 and failing to appear personally in court on multiple occasions.“Defendant has sustained a campaign of dilatory tactics that have indefinitely extended this years-long litigation while denying plaintiff his day in court,” Judge Wilson wrote. “This was not a product of excusable neglect but rather of coordinated strategy.”Mr. Biden’s attorney, Bryan Sullivan, welcomed the outcome. “This is a complete vindication for Hunter Biden against the false statements made about him by Patrick Byrne,” Mr. Sullivan said in a statement. “As found by the court, Byrne had no basis to say that Hunter had any involvement with Iran whatsoever.”Mr. Byrne, 63, resigned as Overstock.com’s CEO in 2019 following a reported relationship with convicted Russian spy Maria Butina. He has since become a vocal supporter of President Trump and a prominent figure in efforts to discredit the results of the 2020 presidential election.
