Suspect in Fatal Shooting Was the Target, Cousin Says

A man arrested in Georgia following a fatal shooting on a Brooklyn street was the target of the attack, not the shooter, his cousin said.

“My cousin never had a gun,” Shaun Smith said of 27-year-old Darius Dubarry, who was arrested earlier this week. “He wasn’t even shooting. He was being shot at. He just got caught up in the mix.”

Police said following the arrest in Augusta, Ga., that Dubarry was expected to be charged in the death of Carol Simon-Hayes. The Brooklyn resident was still being held by police there on yesterday. Simon-Hayes, a 35-year-old nurse, was walking to her building on Eastern Parkway in Brooklyn when she was shot on December 15. Police say they believe the gunman was aiming at someone else.

“There were seven or eight dudes on one side of the street shooting at him,” Mr. Smith said. “My cousin was with three or four friends. He said he didn’t have words with any of the dudes.” Mr. Smith said his cousin had left town without knowing Simon-Hayes had died, and said the aspiring boxer would never shoot anyone.
