Trump Announces New 10 Percent Global Tariff After a Supreme Court Ruling Against Him

President Trump is imposing a new global 10 percent tariff in response to the Supreme Court striking down most of his signature tariffs.Mr. Trump reacted defiantly Friday at the White House to the high court’s 6-3 decision that his use of the 1977 International Emergency Economic Powers Act to impose global reciprocal tariffs was an overstep of his authorities. The president claimed the ruling is actually a win for him, saying the high court unintentionally made his ability to levy tariffs more powerful.Mr. Trump says he will use Section 122 of the Trade Act of 1974 to implement the new 10 percent duty. That provision, however, limits the length of tariffs. Mr. Trump would have to go through a longer process to enact more permanent tariffs.Mr. Trump also unleashed a stunning attack on “unpatriotic” Supreme Court justices who ruled against “Liberation Day” tariffs.Three justices who were nominated by Republicans — Chief Justice John Roberts and Justices Amy Coney Barrett and Neil Gorsuch — joined the court’s three liberals to strike down the tariffs.“The Supreme Court’s ruling on tariffs is deeply disappointing and I’m ashamed of certain members of the court, absolutely ashamed for not having the courage to do what’s right for our country,” Mr. Trump said.Mr. Trump claimed justices that sided against him are “just being fools and lapdogs for the RINOs and the radical left Democrats.”“They’re very unpatriotic and disloyal to our constitution,” Mr. Trump added.Justices Brett Kavanaugh, Clarence Thomas, and Samuel Alito dissented. “The tariffs at issue here may or may not be wise policy. But as a matter of text, history, and precedent, they are clearly lawful,” Justice Kavanaugh wrote in a lengthy response.Mr. Trump singled Justice Kavanaugh for praise in Friday’s news conference. “I’m so proud of him,” Mr. Trump said. The president declined to answer if he regretted nominating two justices that ruled against him but Mr. Trump said their decision was “an embarrassment to their families.” He also said he didn’t care if they showed up for his State of the Union address to Congress next week. The Trump administration had argued the country would suffer devastating economic consequences if the president’s tariffs were overturned.Solicitor General D. John Sauer claimed millions of jobs would be eliminated and the future of Social Security and Medicare would be threatened if money already collected through tariffs had to be refunded.A group of small businesses had sued the president, claiming his use of reciprocal tariffs was an overstep of his powers. The United States Court of International Trade and the United States Court of Appeals for the Federal Circuit both previously ruled against the administration. The high court upheld the ruling in the decision released on Friday. “The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration, and scope,” Chief Justice John Roberts wrote in the court’s opinion. “In light of the breadth, history, and constitutional context of that asserted authority, he must identify clear congressional authorization to exercise it.”“Today’s decision declaring IEEPA tariffs unlawful is a powerful reaffirmation of the Rule of Law and Constitutional Separation of Powers that our country is built upon,” the chief executive officer of Learning Resources, Rick Woldenberg, said in an emailed statement to The New York Sun. “As family-owned, mission-driven education companies, we brought this lawsuit to protect our 500+ employees and the schools and families who rely on us.”The Taxpayers Protection Alliance cheered the ruling. “This is HUGE,” the group’s president, David Williams, said in an emailed statement. “The Supreme Court rightfully rules that the President does not have the unilateral power to remake global trade on a whim. A major victory for protecting American consumers and businesses.”
