Italy at a Crossroads on Electoral Reform

Come March 22, Italians will cast their ballots in a referendum aimed at disentangling the careers of magistrates — the word Italians use for judges — from those of public prosecutors, creating two distinct self-governing entities. The proposition before Italy’s electorate reads: “Do you approve the text of the constitutional law concerning ‘Provisions Governing the Judicial System and the Establishment of the Disciplinary Court’, approved by Parliament and published in the Official Gazette no. 253 of 30 October 2025?”Signora Meloni’s conservative governing coalition maintains that this is a long overdue revision of the Italian Constitution of 1948. Certainly much is at stake — and not just the premier’s political fortunes. Italy’s stability and the West’s geopolitical resurrection hang in the balance. Not to mention the very concept of national sovereignty.Known as the Nordio Reform after the Minister of Justice, Carlo Nordio, this law would correct a judicial imbalance in the Italian constitution. The Riforma Nordio proposes a bifurcation of the Consiglio Superiore della Magistratura Italy’s self-governing body for the judiciary — and the creation of a High Disciplinary Court to oversee disciplinary proceedings.This amendment is designed to maximize accountability and minimize the influence of leftist lobby groups embedded in the judiciary. The 1946 referendum establishing the Constitution of the Italian Republic — and abolishing the Monarchy’s Statuo Albertino — came into force on January 1, 1948.Today’s amendment represents one of the most important revisions in the Italian polity’s history. If the “no” contingent wins, Prime Minister Meloni’s migration policy — the Italy-Albania accords — would be crippled, allowing human traffickers to flood il Bel paese’s southern shores with a torrent of illegal migrants. Plus, Signora Meloni’s market-oriented economic reforms might be delayed, stymied, or deleted.Should the “yes” votes prevail, Italy would have a less politicized, more alacritous judicial system that minimizes conflicts of interests in the courts. In other words, left-wing prosecutors and judges would no longer be permitted to swap jobs and wreak havoc on judicial accountability.That is, “Stop the switch.”Current polls find the “yea” and “nay” votes dead even. Separating the judicial careers of judges and public prosecutors has become a volatile public issue. The rhetoric has been so heated that Italy’s head of state, the centrist and sober-minded president, Sergio Mattarella, called for all parties to lower their voices.At a recent ANSA forum, Signore Nordio declared: “We all overdid our tone. I must say that some of the tones were particularly unpleasant, especially when they came from magistrates. From now on, let’s talk only about the substance.” Ever the soul of impassioned righteousness, Prime Minister Giorgia Meloni rightly deplored critics who chose to “drag the referendum into the mud.” She was chiefly referring to the impolitic idea of Naples’ chief prosecutor, Nicola Gratteri, that “gente per bene,” or good people, would not be voting in favor of the Nordio Reform.The implication is that indecent, shady types are chomping at the bit to undue justice in Italy. To its credit, ANSA dutifully reported the governing coalition’s belief that “the reform will bring more efficiency to Italy’s snail-paced and byzantine justice system, with its two levels of automatic appeal even without fresh evidence.”Moreover, it “will help curb the influence of factions in the country’s notoriously politicized judiciary, the left-wing one of which they blame for judicial curbs on migration policy and fighting migrant crime.”According to the president of the Calabria region, Roberto Occhiuto, a prominent member of the center-right Forza Italia, the Riforma Nordio, represents a key component of his party’s and the governing coalition’s guarantor of citizens’ rights.Signor Occhiuto recalls the deep-state lawfare that chronically hounded the late prime minister, Silvio Berlusconi, the founder of Forza Italia and the politico who made possible the ascendance of a woman named Giorgia.If voter turnout is low in the March referendum and the Nordio Reform is not approved, there’s good news nonetheless.According to Reuters, “Italy’s ruling parties have agreed on a sweeping overhaul of the electoral law, two sources said on Thursday, a move opposition parties say is designed to keep Prime Minister Giorgia Meloni in power after elections due in 2027.” That could spell checkmate for the judicial left.
