Pro-Life Movement Faces Potential Setback in Deep-Red Idaho Where Voters May Overturn Abortion Ban

Voters in Idaho, a deep-red state where Republican lawmakers have enacted some of the strictest bans on abortion in the country, are set to weigh in on an amendment that would enshrine abortion protections — and polls suggest that it may have a shot at passing. Abortion is banned in most cases in Idaho, with limited exceptions for rape and incest. The state also has a civil-enforcement ban that lets families sue abortion providers for at least $20,000 if they perform an abortion after six weeks into a pregnancy. In July, an amendment to enshrine protections for abortion, Proposition 1, qualified to be on the November ballot in the Gem State, which President Trump won by roughly 37 percentage points in 2024.Boise State University’s School of Public Service 2026 public policy survey found that roughly 61 percent of residents support Proposition 1, while 28 percent said they were opposed. The survey found that 45 percent of Republicans and 66 percent of independents support the measure. And an earlier 2025 Boise State University survey found that 55 percent of residents support access to abortion through the first trimester. To make matters worse for opponents of abortion access, the vote on the measure comes amid several polls indicating that Democrats are more enthusiastic to vote this year than Republicans. An Emerson College poll released this week found that 78 percent of Democrats said they were very excited to vote, while 66 percent of Republicans said the same. In order to pass, the amendment would need to receive at least 50 percent of the vote. Proposition 1 would amend the state’s constitution to declare that everyone has the right to “make personal decisions about reproductive healthcare that directly impacts the person’s own body.” It would stipulate that the government could regulate abortion after the point of fetal viability, considered to be around 24 weeks, but it would require an exception for medical emergencies. Backers of Proposition 1 submitted 110,000 signatures, which they said was the largest number of signatures for a ballot initiative in the state’s history. The organization that drafted the measure, Idahoans United for Women and Families, or IDUWF, has said that 38 percent of the voters who signed the petition were Democrats, 30 percent were Republicans, and the remaining voters were unaffiliated. Supporters of the amendment have raised concerns about health care access in Idaho as they point to studies showing the state has lost a third of its OB-GYNs since it enacted its abortion laws in 2022. The ACLU of Idaho says the measure would “give Idahoans the freedom to make deeply personal reproductive decisions without government interference up until fetal viability.” It notes that “dozens” of states have enshrined protections for abortion.In fact, 11 states have amended their constitutions to enshrine protection rights since 2022 while some other states have passed legislation to that effect. In at least two states, existing constitutional provisions have been interpreted as protecting abortion.Anti-abortion activists say the Idaho measure does not align with the state’s values and is being driven by misinformation about the existing abortion ban. The president of Right to Life of Idaho, Emily Naugle, told The New York Sun, “Part of Idaho’s identity is our strong families. This proposal not only allows abhorrent late-term abortion, but it also undermines the family, our bedrock.”“Much of the support for Prop 1 stems from a misrepresentation of women’s health care in Idaho,” she said. “The problem is not the law, but the misinformation surrounding our abortion laws.”Donations have been rolling in from donors in favor of the amendment. Boise State Public Radio reported that over the last week, IDUWF, raked in $1.8 million and has roughly $3.8 million in cash on hand. The donations have come from in-state donors but also out-of-state sources such as a former New York City mayor, Michael Bloomberg, who made a $250,000 donation. By comparison, a group opposed to the measure, Too Extreme for Idaho, brought in more than $800,000 since the beginning of August. As of September 16, it had raised more than $2.3 million since July. Anti-abortion activists had been optimistic that the 2022 Supreme Court decision overturning Roe v. Wade would lead to states banning abortion. Several states had “trigger” bans designed to kick in when the landmark decision was overturned. Republican lawmakers in Texas and Louisiana have tried to strengthen their bans and prohibit the shipment of abortion pills to their states. And in 2024, an amendment to enshrine abortion access in Florida failed to hit the vote threshold needed to pass. However, the anti-abortion movement has faced some defeats even in conservative states such as Arizona, Ohio, Missouri, and Montana, where voters passed amendments protecting abortion. As Idahoans prepare to vote on the measure, anti-abortion activists are urging them not to believe the messaging from its proponents that it is about privacy and protecting access to birth control.Ms. Naugle tells the Sun she hopes voters look “below the surface of Prop 1 and lean into their natural suspicions when it comes to this radical overturning of our abortion laws.” She raised concerns that the measure would allow teenagers to obtain abortions without parental consent. Conservative organizations are trying to tamp down support for the measure. Earlier this week, the Church of Jesus Christ of Latter-day Saints sent a letter to Church leaders, to be read before congregations, stating that while the Church is “neutral regarding political parties” it is “working against this initiative.” The letter also implores members to voice their opposition to it “in a respectful manner consistent with prophetic direction of always demonstrating Christlike love and civility in political discourse.”Meanwhile, the Kootenai County Republican Central Committee held a meeting this week to investigate members whose signatures helped Proposition 1 to qualify for the ballot. Idaho is not the only state with an abortion measure on the ballot this year. Voters in Nevada and Virginia, where abortion is legal, will vote on measures to enshrine abortion access.
