Prosecutors Warn of Possible Mischief in Media Overflow Room Sought By Mangione Defense Attorneys

Manhattan prosecutors are warning the judge presiding over Luigi Mangione’s case of potential spectator misconduct if an overflow room is used in the upcoming trial of the alleged UnitedHealthcare CEO killer. In a letter sent to Judge Gregory Carro ahead of Tuesday morning’s pretrial hearing at Manhattan Criminal Court, prosecutors raised concerns “about the possibility” that spectators could “clandestinely record the proceedings and share any such recordings with others.” They recommended using “only an audio feed,” and no video, to prevent illegal recordings, witness intimidation, and jury interference.Overflow rooms provide secondary spaces for spectators to watch or listen to proceedings after the main courtroom fills up. Defense attorneys for Mr. Mangione have accused prosecutors of violating their client’s constitutional right to a fair and public trial by allegedly denying an overflow room and hand-selecting journalists to cover the high-profile case. Mr. Mangione has pleaded not guilty to murder and weapon charges for allegedly gunning down UnitedHealthcare CEO Brian Thompson on a Midtown Manhattan street in December 2024. He faces life in prison if convicted on all charges. With jury selection less than a month away on September 8, Mr. Mangione’s defense asserted prosecutors colluded with the court’s office of administration in “reaching the decision to not utilize an overflow room and to allow hand-picked reporters to cover the trial.” “Criminal defendants have a Sixth Amendment right to a fully public, open and unbiased trial,” the defense wrote in a letter sent on July 31. Mr. Mangione “objects to a process instituted by the Court, with the involvement of the District Attorney, to hand-select which news reporters are permitted to attend the trial and which are not.” On July 16, the state’s Office of Court Administration published a preliminary media access plan on its website for the upcoming trial. The document listed arrival times and courtroom locations and revealed that 68 courtroom seats will be reserved for a list of designated reporters. Remaining seats will be available on a first-come, first-seated basis. Originally created during the 2024 Stormy Daniels hush money trial against President Trump, the court’s media access list, which includes The New York Sun’s court reporter, was designed to manage overwhelming media demand. The same list was later used during the trials of Harvey Weinstein and Daniel Penny to facilitate access for professional journalists who regularly cover the courts. By granting one seat per outlet, the list seeks to ensure fair access for mainstream, independent, and partisan reporters alike and to prevent large national organizations from packing the courtroom pews and crowding out smaller media outlets. The district attorney’s office was not involved in compiling the access list. Mr. Mangione’s attorneys, however, expressed outrage that the media plan was “created without any consultation with or input from the defense.” They accused prosecutors of engaging with the Office of Court Administration in a “secret process” to select journalists “without disclosing the criteria for selection.” The setup, they argued, excluded “scores of independent journalists who have an interest in covering these proceedings.”The attorneys for the defendant also challenged the plan to implement a six-journalist pool to cover jury selection and protested the fact that no overflow room would be provided, describing the process as “unabashedly arbitrary and insufficient to satisfy the requirements of the Constitution.” The defense attorneys demanded a list of the six pool-journalists for jury selection, the names of the 68 journalists granted courtroom seats, and an explanation of the “criteria and process” used to compile the list. Additionally, they requested details regarding the efforts made to secure an overflow room and asked that the entire trial be televised.Under New York Civil Rights Law, televising court proceedings where witnesses may be compelled to testify by subpoena is strictly prohibited. Court administrative rules sometimes allow for limited audio-visual coverage in certain instances such as arraignments, but the statutory ban heavily restricts cameras in criminal trials. In their initial response, prosecutors pushed back against the “baseless accusation” that they were involved in hand-selecting the journalists, calling the claims “an attempt to spread misinformation.” They denied having any “role” in granting media access and asked Judge Carro to issue a warning against deliberately making “false statements.” But in a second letter sent on August 3, the defense doubled down, requesting the judge “order the preservation and production of all communications—including emails, text messages, and telephone records” between the district attorney’s office and court administrators, and “to conduct” an evidentiary hearing on the matter. An independent criminal defense attorney based in Baltimore interviewed by the Sun as an outside legal expert said he has never heard of a defense team making such requests. Tom Maronick, who hosted a law and politics talk show on a conservative Baltimore radio station owned by the Mangione family, but who is not a consultant for Mr. Mangione or the prosecution, said it’s safe to assume that defense attorneys want a say in selecting the journalists to secure “favorable coverage.” “If the defense has some sort of control or input over who the journalists are, they might select people who are more favorable to the position of the defendant or his background or whatever perspective they might provide,” Mr. Maronick told the Sun. “You never know who a juror will go home and talk to. You don’t know what happens once the court closes its doors for the day and the jury leaves. The jury can be admonished not to discuss the case. But how does the court fully control that? The answer is there’s not really any way to control it,” he said. Some of Mr. Mangione’s supporters have been attending the court pretrial proceedings, including three influencers who call themselves “The Mangionistas.” The three influencers, Lena Weissbrot, Ashley Rojas, and Abril Rios, sparked controversy recently when they were granted press passes. They say they view Mr. Mangione as a folk hero and a modern-day vigilante against a “corrupt, profit-driven” American healthcare system. To them, the late UnitedHealthcare CEO symbolized a “parasitic” industry that profits off the illnesses of ordinary citizens and “murders” people by denying them the healthcare they need. The Mangionistas and other supporters have reportedly begun sharing information about “jury nullification,” a legal concept in which a jury finds a defendant not guilty even if it believes the defendant technically broke the law. Mr. Mangione’s supporters may be seeking to influence potential jurors to disregard the criminal charges and acquit Mr. Mangione based on a shared anger toward health insurance companies. Mr. Maronick said it likely crossed the minds of defense attorneys to get their client’s supporters into the courtroom to create optics in Mr. Mangione’s favor. The defense is interested in three goals: “Number one, you’re trying to get an acquittal. Number two, you’re trying to find one juror who will hang the others and cause a hung jury. Number three, you want to preserve a record for any potential appeals,” he said. In Monday’s letter, prosecutors sounded well aware of possible arguments the defense may try to pocket in case it needs to pursue an appeal and asked Judge Carro to “make a record of the efforts it has undertaken to provide access to the trial.” Prosecutors “take no position on the precise number of seats reserved for members of the press and members of the general public,” they wrote. “Nor do we take any position on which members of the press should receive access to the trial or how they should be chosen.” They “deferred to the Court’s judgment” in regulating access, reminding the judge that “the demand” from the media and the public “would outstrip the courtroom’s physical capacity,” especially during jury selection when close to 100 jury candidates will fill the court’s benches waiting to be questioned by the judge and parties. In the meantime, the Office of Court Administration appears to be bending to the defense’s requests. In a statement to the Sun last week, the communications department said that it is “actively finalizing the plan for the upcoming trial, including arrangements for an overflow room.” “We remain firmly committed to providing the greatest possible access for both the media and the public. At this time, we are carefully evaluating the complex logistical and safety considerations involved in accommodating those who wish to observe proceedings, while ensuring that the courthouse continues to operate with minimal disruption of the hundreds of other matters scheduled each day. More information will be provided as soon as these plans are complete,” the email reads.
