Supreme Court Strikes Down Campaign Finance Law That Limited Political Party Spending

President Trump is celebrating a Supreme Court decision that allows political parties to coordinate spending with candidates in federal elections.In a 6-3 opinion Tuesday, the conservative majority said that the law’s “limits on political parities’ coordinated expenditures” violates the First Amendment.The decision stems from a 2022 lawsuit by Vice President Vance, who was running for Senate at the time. The suit argued that the spending limits were unconstitutional. Republican political committees then joined the case.National Republican Senatorial Committee v. Federal Election Commission contested the Federal Election Campaign Act — a campaign spending law that curbed how much the political parties could spend in support of candidates for federal office. The Supreme Court upheld the limits in its 2001 FEC v. Colorado Republican Federal Campaign Committee decision, but Republican groups asked for it to be revisited because they said the “factual backdrop” has changed since that ruling. They framed the case as a First Amendment issue.The court agreed, and a decision written by Justice Brett Kavanaugh, stated that the reasoning in the prior ruling “has been rejected by subsequent cases and is no longer good law in light of the Court’s more recent precedents.”The relative power of political parties has substantially diminished in comparison to outside groups since the 2001 decision, with political action committees growing in importance related to campaign financing.“To uphold the political-party coordinated-expenditure limits here could therefore help consign political parties to continued second-tier status as compared to outside groups,” Justice Kavanaugh wrote.Justice Elena Kagan penned a dissent that was joined by the other two liberal justices. She argued that the decision “jettisons a rule needed to protect our democracy’s integrity.”Justice Kagan said there was no reason to overturn the previous decision. “Today’s decision thus can join the parade of those recently overruling established law because of a new majority’s new outlook on a consequential matter,” Justice Kagan added.Supporters of the decision said it is a victory for Americans wishing to pool resources in support of a shared political message. “The Supreme Court just took restrictions off political spending! A BIG WIN FOR REPUBLICANS and, more importantly, The First Amendment!” Mr. Trump posted on Truth Social.The Institute for Free Speech said the decision corrects a two-decade-old mistake. “This is a landmark victory for the First Amendment and for the millions of Americans who exercise their political rights through the parties they support,” the conservative group’s senior attorney, Brett Nolan, said in a statement. “As the Supreme Court recognized today, more than half the states have operated for years without restricting coordinated party expenditures, and there is no evidence of the corruption the federal government fears.”
