Congressman Max Miller, Accused of Domestic Violence, Demands Ethics Committee Open Investigation Into Him

In an effort to tamp down on calls for his resignation, Congressman Max Miller is asking the House Ethics Committee to investigate him after being accused of domestic violence by his ex-wife. Several Republican lawmakers on Capitol Hill — including his former father-in-law — have said Mr. Miller should step down. Last week, Mr. Miller’s ex-wife, Emily Moreno, asked a judge to impose a restraining order on the congressman. She says he sprayed hot water on her, held a gun to her head, and broke their daughter’s collarbone. Mr. Miller denies all of the accusations. “My former wife is engaging in a pattern of reporting incredibly serious and destructive allegations with absolutely no evidence,” Mr. Miller said in a 15-minute video statement on Sunday. “Every single one of these allegations were already investigated.” As part of that statement Sunday, Mr. Miller released several documents showing communications between himself and his ex-wife in which they appear to have a friendly relationship. The documents also include records of closed investigations into abuse allegations, all of which were shuttered after investigators were unable to corroborate the accusations.On Tuesday, Ms. Moreno’s attorney, Subodh Chandra, wrote a letter to Mr. Miller’s attorney, Aaron Minc, accusing him of releasing a photo of Mr. Miller and Ms. Moreno’s two-year-old daughter. The photo apparently captured the toddler’s genitals, according to Ms. Moreno’s attorney. “The first time Miller shared the folder, it contained private images of Miller and Ms. Moreno’s daughter and left her name unredacted. At least one of those images could be considered Child Sexual Abuse Material (CSAM) because the daughter’s genitals appear to be visible,” Mr. Chandra wrote to Mr. Miller’s attorney, demanding answers about how this could happen. The image was viewed more than 200,000 times between the time it was posted on Sunday and the time it was taken down on Monday, according to Mr. Chandra. In a statement, Mr. Minc acknowledged that the photo, had in fact, been posted. He said that it was “completely unintentional and a mistake. Mr. Minc said he took the photo down “immediately” after finding it in the files on Monday morning, nearly a full day after it had been posted. The pressure on Mr. Miller to step aside has been immense. On Sunday, after Mr. Miller posted his video statement, his former father-in-law, Senator Bernie Moreno, said Mr. Miller should no longer be serving in Congress. “As he has admitted privately, Max Miller needs serious psychological help. He is a danger to my daughter, and I hold my breath every minute he has custody of my granddaughter,” Mr. Moreno wrote in a statement on X Sunday. “If there are any basic standards of character required to hold elected office, Max Miller fails them. He should not serve in the House of Representatives.”After Mr. Moreno made his statement, several other Republican senators backed him up. Senators John Kennedy, Rick Scott, and Roger Marshall agreed that Mr. Miller should go. On Tuesday, Mr. Miller made clear that he has no interest in stepping down or quitting his re-election race. In a post on X, he asked the House Ethics Committee to open an investigation into him so that the issue can be properly addressed. “I have absolutely nothing to hide,” Mr. Miller said. “The accusations continue to change, but my facts stay the same. I am looking forward to my colleagues reading everything for themselves.”President Trump, meanwhile, has said he will let the investigations play themselves out. Mr. Miller served as one of the president’s aides during his first term in the White House. “It’s a very sad thing. I know Max. He’s a good person. I mean, I always thought he was a very good person. And I’m going to let the families figure that out,” Mr. Trump told reporters in the Oval Office on Monday. “But it’s accusations and I’m going to let them figure that out.”Some Republicans hope Mr. Miller will suspend his campaign before the end of the day on Wednesday, which is the last day he can drop out of the race and allow the Republican Party to choose a new candidate. Mr. Trump only won Mr. Miller’s district by about ten points in 2024, which would make the district a target for Democrats even if a non-scandal-plagued incumbent was running.
