Censoring New York’s School Boards in the Transgender Debate

A Washington state female high school wrestler’s allegation that she was sexually assaulted by a transgender competitor — and recorded by her mother in a shocking phone video — is stoking debate over allowing athletes born as males to compete in women’s sports. Watch out in New York, though, where the state’s attorney general, Letitia James, is imposing a de facto gag order on school board members and parents when it comes to transgender matters. Worse, a federal district judge is refusing to back the rights of New York State school board members and parents of public school students who seek to challenge Ms. James’s policy. In 2025 Ms. James issued “guidance” to school boards. She threatened to remove members “for publicly supporting sex-separated interscholastic sports,” the board members asserted, or if they used “pronouns that correspond to biological sex at public school board meetings.”Ms. James, joined by the state education commissioner, Betty Rosa, said the policy is meant to bar comments at school board meetings that “demean and stigmatize LGBTQ+ students,” meaning pupils who are gay, transgender, or both. Such comments include sowing doubt over the purported right of transgender students to play on teams that are “consistent with their gender identity,” per Ms. James. Such talk, she said, creates “a hostile school environment.”The alleged assault in Washington State — it was in wrestling — is one incident marking that the case is far from closed when it comes to the merit of having transgender athletes compete against female students in school sports. Ms. James seeks to foreclose dialogue. Her guidance to school boards and parents warns that “board members may be removed” if, by speaking frankly on these issues, “they willfully neglect their duty or engage in official misconduct.”No wonder, then, that the board members and parents took to federal courts seeking to void Ms. James’s policy and her enforcement of it. The policy, the board members averred in their legal complaint, would “require school board members across New York to self-censor.” Ms. James’s guidance, too, would, the board members argue, “shut down parent speech that advocates for their core values and for children’s privacy, safety, and opportunity.”After all, the complaint adds, “if school board members and parents disagree” with Ms. James’s views on, say, transgender athletics, “they cannot speak.” And if the board members and parents did express their views, the lawsuit asserts, they “risk being removed from their elected offices,” while risking “being publicly and falsely branded a bully and harasser of children.” So much for the open debate that should be a matter of course at school board meetings.It’s not our intention here to condone any animus toward transgender individuals. It is our intention, though, to mark that in the debate on transgender rights, activists on both sides deserve an open airing in policy-making forums like school boards. That requires unfettered debate in which critics of the transgender rights movement can be free to express their views. Policies like Ms. James’s threaten to short-circuit this kind of dialogue.The lawsuit against Ms. James states that federal legal precedents hold that “discrimination against speech because of its message is presumed to be unconstitutional.” Yet the judge in the New York case, Anne Nardacci, a Biden appointee, on Monday refused to halt Ms. James’s policy while the legal dispute moves forward in court. Judge Nardacci held that the board members and parents did not “face a credible threat of enforcement.”Judge Nardacci waves away concerns about Ms. James’s letter, calling it “informal guidance” that expresses the Attorney General’s “interpretation of state law.” In other words, per Judge Nardacci, there’s nothing to see here, folks, shuffle along. The school board members’ case is pending in court, and could yet reach higher tribunals. It’s hard to imagine that Judge Nardacci’s justification of de facto censorship will prove the last word in this national debate.
