Congressman Moves to Ban Pregnant Foreigners After Supreme Court Upholds Birthright Citizenship

Hours after the U.S. Supreme Court upheld birthright citizenship, second-term Tennessee Representative Andy Ogles introduced legislation that would ban pregnant foreign nationals from entering the United States — escalating a battle between the legislative and judicial branches over one of the Constitution’s most contested provisions.The bill quickly attracted attention from Republican leadership. House Speaker Mike Johnson of Louisiana said lawmakers are “looking at” the proposal, adding that “birthright citizenship has been abused” and that Congress must “address the issue as quickly and as efficiently as we can.”The Supreme Court’s 5-4 ruling struck down an executive order from President Trump that sought to overhaul birthright citizenship, with Chief Justice John Roberts citing an 1898 precedent to reaffirm that children born on U.S. soil are entitled to citizenship regardless of their parents’ immigration status.“Children born in the United States to parents unlawfully or temporarily present here are thus subject to the nation’s jurisdiction,” Justice Roberts wrote in the majority opinion.Mr. Ogles wasted no time responding. His bill, dubbed the “Anchors Away Act,” seeks to amend the Immigration and Nationality Act by narrowing who qualifies as a U.S. citizen at birth.Under the proposal, at least one parent must be an American citizen or legal permanent resident for their child to receive citizenship. The bill would also allow immigration officials to refuse entry to pregnant foreign nationals who are not married to U.S. citizens.Mr. Ogles framed the legislation as a necessary check on judicial overreach. “We are literally going to be dropping Anchors Away, which really pushes back against the Supreme Court. This idea that if you are pregnant and you are from a foreign nation — you know what, it is time for Congress to pass a law that says you cannot come here,” Mr. Ogles said on Fox News. “You cannot have a baby on U.S. soil and exploit this loophole.”Mr. Ogles was sharper on social media, calling the ruling “not only a betrayal of American sovereignty, but a direct attack on our national security.”“Because of birthright citizenship, foreigners are being born on our soil, groomed by communists and globalists, and embedded into our society. They are running for OUR political offices. They are collecting American benefits. And they are actively colonizing our country,” he wrote.“No more anchor babies. Save our sovereignty. SCOTUS betrayed America,” he said in another post. Mr. Trump also weighed in via Truth Social, urging Congress to act and dismissing the need for a constitutional amendment. “Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!” Mr. Trump wrote.
