Judge in Luigi Mangione Case Sets Two Trial Dates, for a Death Penalty or Non-Death Penalty Trial

The federal district judge, Margaret Garnett, who presides over the case against Luigi Mangione, the Ivy League graduate accused of killing the UnitedHealthcare CEO, Brian Thompson, scheduled jury selection for the trial for September 8. But she set two alternate dates for the actual trial, one for a capital and one for a non-capital trial. She has yet to rule if she will dismiss the death penalty eligible charge of the indictment, in which case the non-capital trial would move forward.As the Sun reported, the judge is currently reviewing arguments raised by the defense that a legal technicality gives reason to eliminate the death penalty eligible charge. On Friday, Judge Garrett did not give any indication how she would rule on the matter and scheduled two trial dates. If she decides to allow federal prosecutors to seek the death penalty, the trial will begin on January 11, 2027, giving the parties four months after jury selection to prepare. If, however, she agrees with the defense and dismisses the death penalty eligible count, opening arguments for a less complex, non-capital trial will be held on October 13. Mr. Mangione, 27, is being prosecuted in three separate jurisdictions for shooting Thompson: At Manhattan criminal court, in Pennsylvania, where he was arrested, and at the Southern District, where federal prosecutors have charged him with “murder through the use of a firearm,” which is death penalty eligible. Mr. Mangione has pleaded not guilty to all charges. No date for the state trials have been set yet. On Friday, Mr. Mangione appeared at federal court, unshaven, shackled at his feet and wearing beige prison garb. He has been detained at the notorious Metropolitan Detention Center in Brooklyn, since he was extradited from Pennsylvania to New York last December. Five days after Thompson, a Minnesota father of two, was gunned down on a Midtown Manhattan street, Mr. Mangione was arrested at a McDonald’s about 270 miles west of New York City in the center of a town called Altoona, Pennsylvania. Judge Garrett had summoned the parties for a suppression hearing to determine whether or not Altoona police officers violated Mr. Mangione’s due process rights during the arrest when they searched his backpack without a warrant. The defense has argued that the search was unlawful and the judge should thus exclude all evidence found inside the backpack from the upcoming trial. About 14 Altoona police officers were present when Mr. Mangione was arrested at the local McDonald’s. When two officers searched his backpack at the fast food restaurant, they found a loaded magazine with bullets that match the shell casings from the crime scene, according to New York detectives. When the female officer continued searching the backpack at the precinct, still without having obtained a warrant, she found a 3D-printed handgun and a red notebook, which includes disparaging writing against the health insurance system.A 19-year Altoona Police Department veteran, Christy Wasser, testified during the State of New York’s suppression hearings held at Manhattan Criminal Court in December, that she followed regular police procedure, citing “search incident to an arrest” regulations that permits the search of an arrested person and their belongings without a warrant primarily for safety reasons. In a direct reference to the suppression hearings at state court, which lasted almost three weeks, the district judge assured the parties on Friday that she was “not having this (hearing) turn into a circus.” Friday’s hearing lasted about one hour and 45 minutes. Assistant U.S. Attorney Dominic Gentile called one witness, Altoona Police Deputy Chief Nathan Snyder. Mr. Synder, who was not directly involved in the arrest of Mr. Mangione, was promoted to deputy chief in January of this year, but has been with the Altoona Police Department since 2009. Under direct examination, the deputy chief explained to Mr. Gentile that all Altoona police officers must adhere to a book of general orders. When new officers are trained they are quizzed on so-called “task sheets” which are directly derived from these general orders. The prosecutor asked about inventory and safeguarding procedures of a detainee’s property, but did not mention acquiring a search warrant during his examination which lasted under 30 minutes. Defense attorney Marc Agnifilo, whose wife, Karen Friedman Agnifilo leads the defense team, also promised to be quick, telling the deputy chief that he would get him back to Altoona before “ice and snow hit the earth,” a reference to the upcoming snow storm expected to blast the Northeast this weekend. Mr. Agnifilo pointed out that the guidelines laid out in the general orders “don’t say anything about a bag” such as Mr. Mangione’s backpack. Specific sections detailed how to handle property on a detainee’s body, such as belts or hats, but completely failed to mention how to handle a backpack.Judge Garrett, who was appointed to the bench by President Biden in 2024, after serving as the deputy United States attorney at the Southern District, where she had also worked as an assistant district attorney from 2005 to 2017, asked the witness how he would handle her purse, if he arrested her on a bus. Mr. Snyder explained that after padding down and handcuffing the suspect, he would take the purse to a “controlled area,” like a police car or the precinct, and conduct a search “for our safety.” The defense attorney asked what he would do, if he found a firearm in the purse. “If you found something illegal,” Mr. Agnifilo asked, “would you do anything other than continue?” “No,” Mr. Snyder testified, “We would probably get a search warrant.” The witness added that if an officer would discover evidence of a crime inside a bag, the officer “should probably stop the search and get a warrant.” But under re-direct the witness contradicted himself. “If you found contraband would you continue searching, if you found ammo would you continue searching for more dangerous items?” Mr. Gentile asked his witness. “Yes,” Mr. Snyder replied. At the very end of the conference hearing, Mr. Agnifilo read from the police manual, from a section that discusses how to search an impounded vehicle that said, “when evidence for a crime is discovered the officer shall stop the search and obtain a warrant.”Mr. Angifilo asked the witness if there were any guidelines in the manual that pertained to searching bags, and the deputy chief answered, “I’d have to read through the entire manual.”The judge thanked the witness for his testimony before excusing him. The next hearing is scheduled for January 30.
