Supreme Court Rejects Page’s Wiretapping Lawsuit Against Comey

The Supreme Court will not take up an appeal request by President Trump’s former campaign adviser, Carter Page, who sued the former FBI director, James Comey, and other FBI officials over being surveilled during an investigation into Russian interference in the 2016 election.The FBI launched “Crossfire Hurricane” in July 2016 to look into whether individuals associated with Mr. Trump’s campaign were coordinating, wittingly or unwittingly, with the Russian government’s efforts. The FBI submitted opposition research generated by counterintelligence specialist Christopher Steele to a secret surveillance court to obtain a spy warrant for Mr. Page even though the CIA had warned the FBI that the sourcing in the so-called Steel Dossier was unreliable. Much of the information in the research was later debunked.A December 2019 Justice Department inspector general found that the process used to obtain the wiretap warrant was faulty with at least 17 significant errors or omissions in the applications but no “evidence of intentional misconduct.”Mr. Page denied having any improper ties to Russia and was never charged with a crime. He later sued Mr. Comey as well as a former FBI deputy director, Andrew McCabe, and five others for allegedly violating the Foreign Intelligence Surveillance Act.A federal judge ruled that Mr. Page had waited too long to file his lawsuit and had not sued the people who actually carried out the surveillance. The U.S. Court of Appeals for the District of Columbia Circuit upheld the ruling.Mr. Trump claimed the FBI’s investigation of Mr. Page was politically motivated. Mr. Page had also sued the Justice Department and the FBI over the wiretap. The Trump administration settled that portion of the case in April and agreed to pay $1.25 million.The Supreme Court’s order did not offer any reasoning for declining the case against the FBI officials but it noted that Justice Ketanji Brown Jackson did not take part in the decision.
