Air Force Audits Fallen Airman’s Benefits as Widow Debates Semantics Over Classification of ‘Operation Epic Fury’

Libby Klinner buried her husband six months ago. This week, the Air Force is auditing whether her family is receiving every benefit it is owed, a review that came only after she went public with her frustration on social media.Major John “Alex” Klinner, 33, was one of six airmen killed on March 12 when their KC-135 Stratotanker went down over western Iraq while supporting Operation Epic Fury, the Pentagon’s military operation against Iran that began 12 days earlier with United States and Israel joint strikes on the Islamic Republic.Klinner left behind his wife, a former teacher, and three young children, including a toddler and seven-month-old twins. Marking the anniversary of his death on Instagram on August 29, Mrs. Klinner wrote that her family was living through “six months of a war we can’t call a war.”“The Air Force recently told me that because we haven’t officially declared war, my kids and I aren’t eligible for some benefits,” she wrote on a video showing her rocking one of her babies.A Casualty Officer’s ExplanationMrs. Klinner says the explanation for the missing benefits first came from her family’s casualty assistance officer, the military liaison assigned to help survivors of fallen service members navigate paperwork and benefits. According to Mrs. Klinner, the officer told her that certain payments tied specifically to combat service could not be issued because Congress has never voted to declare war against Iran. The missing pay, she says, comes down to hostile fire and imminent danger pay, plus the combat zone tax exclusion — benefits that hinge on a legal combat designation that by the government’s account, her husband’s flight never quite met.“Not only was my husband killed in a war he never wanted to participate in, but now the benefits we’re left with are being dictated by semantics and public perception,” Mrs. Klinner wrote. Her husband commissioned through the Air Force ROTC program at Auburn University in 2017. He served as chief of squadron standardizations and evaluations with the 99th Air Refueling Squadron. This Alabama-based unit falls under the Sixth Air Refueling Wing at MacDill Air Force Base in Florida, while its airmen serve day-to-day out of Sumpter Smith Joint National Guard Base at Birmingham. He had been promoted to major in January and had deployed four times since 2019, logging 362 combat and 181 combat-support hours in theater. Mr. Klinner’s final deployment, in support of Operation Epic Fury, lasted less than a week before the crash that killed him.According to the Department of Defense, baseline survivor benefits available to any family of a service member who dies on active duty include the $100,000 death gratuity, Servicemembers’ Group Life Insurance, and VA Dependency and Indemnity Compensation. They are not tied to a war declaration or even a combat-zone designation. Mrs. Klinner has been clear that what she says was withheld are the narrower, combat-pay add-ons, not those baseline payments.A Legal Mechanism Older Than This WarEven so, the Pentagon’s explanation sits uneasily next to how combat pay is actually determined. Hostile fire pay, imminent danger pay, and the combat zone tax exclusion have never depended on a congressional declaration of war.Instead, they flow from a presidential executive order designating a specific combat zone, paired with a Pentagon certification that troops there face hostile fire. Iraq has carried that designation since the Gulf War, when President George H.W. Bush signed Executive Order 12744 in January 1991 covering the country’s land area and surrounding airspace. This designation has never been revoked. Why that status did not apparently extend to a mission flown in support of Operation Epic Fury is a question the Air Force has yet to answer. The larger constitutional question that Mrs. Klinner’s post raises part of an ongoing conflict between the branches of government. The last time Congress formally declared war on another nation was June 4, 1942, against Bulgaria, Hungary, and Romania, following declarations against Japan, Germany, and Italy six months earlier.Every American military engagement since, including Korea, Vietnam, and the post-September 11, 2001, operations in Afghanistan and Iraq proceeded without one. Afghanistan and Iraq, however, differed from the current Iran campaign in one respect: Congress passed specific authorizations for the use of military force in 2001 and 2002, giving the executive branch explicit statutory cover even without a declaration. No comparable authorization exists for Operation Epic Fury. Lawmakers have tried repeatedly to force the issue. Resolutions directing the president to pull troops out absent a formal declaration or use-of-force authorization came up for a vote in March, April, and again in mid-May. Each time the vote fell a handful short of passage.A similar resolution finally passed both chambers in late June, with the Senate voting 50 to 48 and four Republicans joining Democrats. The measure, however, was never binding and never sent to the White House for the president’s signature. As the 1973 War Powers Resolution’s 60-day clock neared its end in April, the administration argued it had already met its obligations because a ceasefire had taken hold, even as elements of the campaign, including a naval blockade, are ongoing. Secretary of State Marco Rubio declared Operation Epic Fury “over” on May 5, describing further American action in the region as purely defensive, a characterization critics on and off the Hill have called an attempt to sidestep the fight altogether. At least 14 service members, including Major Klinner, have died and more than 400 troops have been wounded as part of the ongoing Iran campaign, figures the Pentagon lists under Operation Epic Fury on its official casualty tracker. Four more service members have died since the airmen went down. Three were killed when Iranian ballistic missiles and drones struck a base in Jordan on July 17. A fourth died the next day in Iraq while conducting a controlled demolition of an Iranian drone, They do not appear in the Pentagon’s count. For a few days, the Pentagon’s tracker put the war’s death toll at 18 — then last week the number dropped back to 14, with those four July deaths shuffled into a separate category called “Overseas Operations Casualties.” Officials chalked it up to “temporary data disruptions.”The four had been killed in fighting that resumed after the administration declared the conflict over in April, and Senate Democrats, including Arizona’s Mark Kelly, have since demanded the Pentagon account for the discrepancy.A Viral Claim, an Unverified DetailMrs. Klinner’s post has since spread widely, amplified by memes casting the benefits dispute as proof of Republican unwillingness to declare war formally. On the flip side, she has also been criticized that her husband should never have signed up for the military if he didn’t want to be in a “war.”An undersecretary of defense for personnel and readiness, Anthony Tata, wrote on X on September 1 that officials had reached out to Mrs. Klinner and her family “to confirm they have received all of the entitlements they are owed,” without specifying whether that included the combat-pay items she says are missing.Mr. Tata, a retired brigadier general, added that the Department of Defense remains committed to providing Mrs. Klinner and her children with “seamless, long-term support.”The Air Force Opens an AuditTwo days after Mrs. Klinner’s initial post drew national attention, she said the director of Air Force Mortuary Affairs Operations contacted her directly. The Air Force is opening a review of her family’s case to make sure nothing owed to them was missed, according to Mrs. Klinner. An Air Force spokesperson confirmed that officials spoke with Mrs. Klinner this week “to ensure she is receiving all eligible benefits she and her family are entitled to, as well as ensure all her questions are fully addressed.”The spokesperson further underscored that the service is committed “to providing clear information and continued support to Mrs. Klinner, as well as all the families of the Airmen who died in the KC-135 crash.” The Air Force has not explained why she was initially told the extra benefits were unavailable nor has it said whether other Gold Star families from the Iran campaign have run into the same issue.Mrs. Klinner, a graduate of the University of Alabama, has said she turned off comments on her recent posts after receiving hostile messages accusing her of seeking attention. She has pushed back on the suggestion that her husband’s death was somehow his choosing.“No one joins the military because they want to go to war,” she wrote. “They chose to defend their country knowing they could be sent to war but hoping they won’t be. They also join with the assumption that a war would be the last resort, which was not the case in Iran.”A GoFundMe campaign, “Honoring Major Alex Klinner — Supporting Libby & Children,” established by Mrs. Klinner’s sister, Sarah Rose Harrill, has raised over $1.5 million from roughly 14,000 donors, generosity that has nothing to do with the federal benefits system now under review. That system, and the fight over what to call the war that put it in question, is not one she expected to face on top of her grief.
