Appeals Circuits Split Over Rights of Aliens Who Are Here Illegally

President Trump’s push to deport millions of illegals is hitting turbulence in the upper echelons of the federal courts. The riders of the 11th United States Appeals Circuit reckon that Mr. Trump lacks power to detain the border-jumpers without bond until their deportation cases are resolved. This view clashes with the reasoning of appellate judges of the Fifth and Eighth Circuits, who back Mr. Trump. Hence, it looks like a question for the Supreme Court.These legal clashes are best understood in the context of the record-high number of illegals in America, some 14 million, reached in 2023 as a result of President Biden’s lax border policies. The Trump White House has reported some 2.5 million illegals have left, either voluntarily or by deportation. Mr. Trump’s border tsar, Tom Homan, is touting today a buildup of 10,000 more border agents and says 1,200 arrests a day are being made.“Mass deportations are coming,” Mr. Homan crows. Liberal judges on the federal bench, though, seem eager to slow down the push to expel non-citizens. Feature the ruling yesterday by a panel of riders on the Atlanta-based 11th Circuit. The majority, comprising Stanley Marcus, a Clinton nominee, and Robin Rosenbaum, an Obama nominee, finds that illegal aliens who have been living here are entitled to be released on bond during deportation proceedings.“The language that Congress has chosen to use” in immigration and naturalization laws “does not grant to the Executive unfettered authority to detain, without the possibility of bond, every unadmitted alien present in the country,” the riders reckon. By contrast, they find that illegals “seeking admission” who are apprehended shortly after crossing the border have no expectation of being released while their claims are being weighed.A dissenting rider on the 11th Circuit panel, Barbara Lagoa, nominated by Mr. Trump, avers that the majority makes a false distinction. “There is no daylight between an ‘applicant for admission’ and an ‘alien seeking admission,’” Judge Lagoa asserts, and so there is no reason to treat illegals differently depending on how long ago they crossed the border. This appraisal echoes the findings of riders on the Fifth and Eighth Circuits.A Reagan nominee on the Fifth Circuit, Judge Edith Jones, wrote for the majority of a panel of riders that a 1996 enactment fixed the apparent “incongruity” under federal law as far as illegals’ rights on this head are concerned. Even if an illegal migrant were detained in the interior, Judge Jones wrote, that individual “shall be deemed,” as a matter of federal law, “an applicant for admission” and as a result ineligible for bail release during deportation proceedings.The conflicting rulings among the appeals courts creates what’s known in legal parlance as a “circuit split,” making it more likely that the Supreme Court will weigh in on this question. The high court has in past cases like Department of Homeland Security v. Thuraissigiam distinguished between the due process rights of illegal immigrants who are found, say, residing in the interior, as opposed to, say, migrants caught shortly after crossing the border. Do those due process rights encompass a right to be freed on bail while deportation cases wend through the federal courts? Federal law would seem to suggest not, especially if the reasoning of the Fifth and Eighth Circuits’ riders is any guide. With potentially millions of such deportation cases on the horizon, the success of one of Mr. Trump’s hallmark policy initiatives could hinge on how the Supreme Court eventually rules on this question.
