Could Luigi Be Insane? Mental Illness May Be Defense Strategy, Suggests Lawyer Familiar With Mangione Family

The man accused of gunning down UnitedHealthcare CEO Brian Thompson will appear in a Manhattan criminal courtroom on Tuesday for a hearing that could pivot around a defense strategy declaring Luigi Mangione not fit for a guilty verdict. A criminal defense lawyer told The New York Sun on Monday that a ruling expected by the presiding judge, Gregory Carro, decided after a closed-door hearing last week could reveal whether attorneys may try a mental health defense as part of a shift in Mr. Mangione’s strategy.The New York State Office of Court Administration told reporters in an email last week that the judge’s upcoming decision on a “pending matter” would be made public. It’s unclear whether the judge will address the contents of a secret conference between him and the parties to the case during Tuesday’s court session, or whether he will present his decision. Even if Judge Carro does make his decision public, it may not reveal much about the actual content of the conference, a criminal defense attorney who previously hosted an independent radio show at a station owned by the Mangione family, Thomas Maronick, told the Sun. “The order may be very general,” Mr. Maronick said. “I’ve seen that happen many times.” Mr. Maronick, who is not an attorney for the defendant, said the secrecy could be related to a change in strategy. “It could be related to a change in the status with the defense; they could be re-looking at a mental health defense, that could be part of it,” Mr. Maronick opined. “From the very beginning of this case, I believed the best possible defense would be something related to mental health.”Mr. Mangione, who comes from an affluent family in the Baltimore area, was a highly accomplished student named valedictorian of his high school. He graduated cum laude from the University of Pennsylvania, earning both a bachelor’s and a master’s degree in computer science.On December 9, 2024, he was arrested at a local McDonald’s at Altoona, Pennsylvania, after a customer reported to the manager that the young man eating his breakfast at the fast-food restaurant resembled the suspect wanted for shooting Thompson on a Midtown Manhattan street.Five days before the arrest, Thompson was gunned down on his way to attend an annual investor conference at the New York Hilton hotel. Thompson, a father of two, died at the hospital 30 minutes after the shooting. The suspect, who had been caught on surveillance cameras, fled the scene, triggering a nationwide manhunt.Mr. Mangione currently faces three separate trials in three different jurisdictions, all related to Thompson’s murder. In federal court, Mr. Mangione is accused of stalking his victim across state lines. In Pennsylvania, where he was arrested, he is charged with carrying a firearm without a license, forgery for presenting a fake driver’s license, false identification to law enforcement, and tampering with identification. In New York, he is charged with second-degree murder and several firearm counts. Mr. Mangione has pleaded not guilty to all charges.So far, the defense attorneys have not made any indication that they are planning to pursue a mental health defense. However, last August, in a publicly filed letter, they did ask the judge for more time before informing the prosecution of their decision on pursuing such a defense.Mr. Maronick said that the defendant may be more willing to consider the mental health argument because he has now been imprisoned for over a year and has learned what it’s like to be an inmate. Having been charged in a federal court, Mr. Mangione is being held in the Metropolitan Detention Center at Brooklyn, the same facility where the deposed president of Venezuela, Nicolás Maduro, and his wife, Celia Flores, currently reside.“Maybe it was something that they didn’t pursue because the client had said, ‘We’re not doing this.’ But as you get closer to a trial date, defense attorneys talk about different strategies that maybe hadn’t been near the surface for a while, and sometimes you get different responses,” Mr. Maronick said. “I really do believe that the length of time that somebody who has never been in jail before is in jail can influence his decisions, and sometimes lead to him saying, ‘Okay, well, I initially said I’m not doing that, but now, maybe yes.’”Mr. Maronick said the district attorney’s position is that Mr. Mangione was clearly aware of what he was going to do as demonstrated by his knowledge of the CEO’s whereabouts before the conference. “The fact that this took place before a meeting that he knew the CEO was attending, that took a tremendous amount of planning. That’s one argument,” Mr. Maronick said.On the other hand, Mr. Maronick said, his attorneys may argue that “he had been detached from reality, that he had gone off the grid, his family couldn’t find him, they’d had to hire a private investigator to find out where he was, that he was suffering severe health issues, and in such physical pain that it affected his ability to really understand what was going on.”In July 2024, four months before the alleged shooting, Mr. Mangione stopped posting on social media. Family members reached out to his friends for help tracking him down but were unsuccessful. On November 18, 2024, his mother reported him missing to the San Francisco Police Department; she stated that the family had not heard from him since July.Handwritten notes and forum posts indicated Mr. Mangione had experienced backaches related to spondylolisthesis, a condition that occurs when a vertebra shifts out of alignment due to a stress fracture, leading to severe nerve compression, sciatica, and chronic, debilitating pain.His condition acutely worsened during a stay in Hawaii where he was in a surfing accident, which caused severe spinal misalignment and a fracture in the pars bone. According to various media reports, he underwent back surgery in August 2023. Mr. Mangione posted a picture of an X-ray of a spinal surgery on his X profile and a review on Goodreads of a book called “Crooked: Outwitting the Back Pain Industry and Getting on the Road to Recovery.”“The X-rays that I saw, and I’m not a doctor, looked very painful,” Mr. Maronick said. “So that could be argued. Whether or not that’s being re-examined, I don’t know, maybe it’s something that they didn’t want to be known by members of the media or the public. Because you’ve got to also find a jury pool that’s willing to be fair and impartial, and it’s going to be hard enough to begin with.” The attorney further said that “paranoid schizophrenic” resulting from the back pain Mr. Mangione experienced could be an argument the defense is now willing to make.Mr. Mangione’s lead defense attorney, Karen Friedman Agnifilo, who earned her law degree at Georgetown University, spent years as a lead prosecutor at the Manhattan district attorney’s office before leaving in 2021 to eventually join her husband Marc Agnifilo’s private practice. During her time as a prosecutor, she played a lead role in establishing a specialized mental health court aimed at diverting eligible defendants from incarceration and into treatment. According to friends, her commitment to mental health issues stems in part from challenges faced by a close relative, the Wall Street Journal reported in December 2024.Before Ms. Friedman Agnifilo was retained by Mr. Mangione, she told CNN that “there might be a non-guilty by reason of insanity defense because the evidence is so overwhelming.”The hearing is scheduled to begin at 9 a.m. ET on Tuesday morning.
