Federal Anti-Abuse Law Championed by Melania Trump Nabs First Convict, but Free Speech Challenge Is Coming

James Strahler II had more than 100 AI models loaded onto his phone and a target list drawn from the neighborhoods around him. Between December 2024 and June 2025, the 37-year-old Columbus man used those tools to generate pornographic images and videos of real women and children he knew — then sent them to their co-workers, family members, and posted them to abuse websites online.On April 7, 2026, he walked into a federal courtroom in Columbus. He pleaded guilty to three counts, becoming the first person in America convicted under the Take It Down Act, the federal law championed by first lady Melania Trump and signed by President Trump in May 2025.The guilty plea before Chief United States District Judge Sarah D. Morrison landed hard in Washington.“Today marks the first conviction under the Take It Down Act, protecting victims from nonconsensual AI-generated sexually explicit images, cyberstalking, and threats of violence,” Mrs. Trump wrote on X shortly after the plea was entered.“We will not tolerate the abhorrent practice of posting and publicizing AI-generated intimate images of real individuals without consent,” added U.S. Attorney Dominick S. Gerace II.Mrs. Trump noted in a separate statement that she was proud to have worked with Congress to provide prosecutors with a strong legal mechanism to protect innocent victims from cybercrimes of this nature. White House press secretary Karoline Leavitt called the conviction “a huge achievement for the first lady” and said the president was very proud of his wife’s efforts in getting the critical legislation passed.A campaign of digital violenceFederal prosecutors laid out a pattern of harassment that stretched over six months and left at least 10 people, adults and children, as victims. Mr. Strahler had installed more than 24 AI platforms and over 100 web-based AI models on his phone. Investigators recovered roughly 2,400 flagged files; he had also uploaded more than 700 images to a website dedicated to distributing child sexual abuse material.The adult victims were predominantly women. Mr. Strahler sent harassing messages to at least six of them, attaching both real photographs and AI-generated nude images. In at least one case, he used the technology to produce a video depicting a woman engaged in sex acts with her own father, then distributed that video to her co-workers.He accompanied the imagery with explicit voicemails, text messages, and written threats of rape. His conduct toward children was equally disturbing — he took images of boys he knew in his community and morphed their faces onto the bodies of adults or other children to create material depicting them in sex acts with family members.The investigation began after one victim contacted the Hilliard Police Department about threatening messages she and her mother had received. Local officers traced online aliases back to a Columbus apartment, secured devices, and brought in the FBI’s Cincinnati Division and the Maryland AI and Synthetic Media Threats Task Force to process the digital forensics. Federal charges followed, and Mr. Strahler was arrested in June 2025.Sentencing has not yet been scheduled. Those convicted under the law face fines and up to two years in prison when adult victims are involved and up to three years when the victims are minors.What the law prohibitsThe Take It Down Act, introduced by Senator Ted Cruz, a Republican of Texas, and co-sponsored by Senator Amy Klobuchar, a Democrat of Minnesota, passed the Senate unanimously and cleared the House on a 409-2 vote before Mr. Trump signed it into law. The legislation creates several distinct federal offenses under the umbrella term “publication of digital forgeries” — the statute’s specific language for deepfakes — and makes it a federal crime to publish knowingly nonconsensual intimate imagery, whether authentic or AI-generated.Beyond the criminal provisions, the law requires online platforms to remove flagged nonconsensual content within 48 hours of a verified notice and to make reasonable efforts to identify and delete identical copies across their systems. Enforcement authority over platforms falls to the Federal Trade Commission. Platforms have until May 19 to have those takedown systems in place.Mr. Strahler’s case drew from multiple provisions simultaneously: the cyberstalking statute, an existing federal law covering obscene visual representations of child sexual abuse material, and the new Take It Down Act’s digital forgery offense. The combination of charges reflects both the breadth of his conduct and federal prosecutors’ appetite for stress-testing the law’s reach across different categories of abuse.While at least 45 states have independently enacted laws targeting AI deepfakes, the federal statute extends jurisdiction across state lines and subjects platforms for the first time to uniform national removal obligations.A landmark — with an asteriskLegal observers and digital rights organizations have praised the outcome while raising pointed questions about how the same law will operate in less clear-cut circumstances.The Advisory Solutions Director of TrustedSec, Alex Hamerstone, told The New York Sun the Strahler case, while historic, has structural limits as a precedent.“This is an egregious case, and by most accounts the volume and nature of the images made it relatively straightforward to prosecute,” Mr. Hamerstone said. “However, because Strahler pleaded guilty, the case didn’t go to trial and the law wasn’t fully tested, which limits its value as a broad legal precedent.”He noted that the real question is how courts will handle more ambiguous cases — those involving fewer images, less clear patterns of harassment, or mitigating circumstances.“This is where the boundaries of the law are more likely to be contested,” he said.The Electronic Frontier Foundation, the Center for Democracy and Technology, the Freedom of the Press Foundation, and more than 10 allied organizations wrote to the Senate before passage, arguing that the statute’s takedown provisions apply to a much broader category of content than the narrower nonconsensual intimate imagery definitions found elsewhere in the bill.The 48-hour removal window is a particular pressure point. A policy fellow at the Stanford Institute for Human-Centered AI, Riana Pfefferkorn, told the Sun that the compressed timeline creates dangerous structural incentives toward censorship.“48 hours is extremely short, which — coupled with the penalties for violating the removal requirements — incentivizes tech platforms to quickly remove anything for which they receive a takedown request without scrutinizing the request too carefully to confirm that it’s valid,” Ms. Pfefferkorn explains. “And then, once the material is down, there is no mechanism in the law to ensure it can get put back online again if it was not a valid removal request.”She drew a pointed comparison to the Digital Millennium Copyright Act, noting that even the DMCA, for all its documented abuse problems, provides users with an appeals mechanism and imposes no hard removal deadline. The Take It Down Act has neither.“Those differences make Take It Down even more susceptible to abuse than the DMCA, something that lawmakers ignored despite being vociferously warned about it while the bill was being debated in Congress,” Ms. Pfefferkorn said.Those warnings have taken on a sharper edge, given Mr. Trump’s statement at the bill signing that he intended to use it to remove content critical of himself, a concern compounded by his March 18, 2025, firing of the Federal Trade Commission’s two Democratic commissioners — Alvaro Bedoya and Rebecca Kelly Slaughter — whose agency is charged with enforcing the platform removal obligations.Ms. Pfefferkorn said that she believes the law will ultimately survive constitutional challenge, citing the track record of state-level nonconsensual intimate imagery statutes.“Many state supreme courts have upheld state-level NCII laws against First Amendment challenges,” she said. “Those courts have held that those laws are narrowly tailored to protect the state’s compelling interest in protecting the health, safety, and privacy of its citizens.”Ms. Pfefferkorn argued the same considerations — statutory definitions, knowledge, and intent requirements — make a successful First Amendment challenge by a criminal defendant unlikely at the federal level.Mr. Hamerstone was direct about the civil liberties concerns, noting that nearly any statute touching speech will draw scrutiny from advocacy groups, but that the practical risks are real.“One could see something like an AI-generated image of a national political figure in some obscene context as possibly being subject to a law of this type,” he said. “One thing is for certain: there will be litigation.”
