Georgia Woman Charged With Murder After Allegedly Taking Pills To Induce an Abortion

A Georgia woman has been charged with murder for allegedly taking pills to induce an abortion. Police at Kingsland, Georgia, arrested 31-year-old Alexia Moore and charged her with murder and possession of a controlled substance — oxycodone — and a dangerous drug, misoprostol, which is used to induce abortion. The charges mark the first time a woman has been charged for an abortion since Georgia passed a 2019 law that bans most abortions.The charges come months after Ms. Moore went to a hospital in Camden County in December, complaining of abdominal pain. According to court records, she told medical staff that she had taken misoprostol, a drug used to induce abortion. Staff at the hospital reportedly tipped off law enforcement that Ms. Moore had tried to abort the baby. The warrant says that the premature baby lived for about two hours after being delivered. The arrest report states that Ms. Moore was beyond six weeks pregnant “based on the medical staff’s knowledge that the baby had a beating heart and was struggling to breathe.”Under Georgia’s Living Infants Fairness and Equality Act, abortion is illegal after cardiac activity is detected, which is usually around six weeks. The Camden County sheriff, Kevin Chaney, told the Current, that the security guards at the hospital had a duty to report her to law enforcement.“They’re law enforcement at the hospital, so they’re not just security officers. They’re actually sworn peace officers in the state of Georgia. And plus your mandated reports and stuff like that. Along those lines, we share information constantly,” Mr. Chaney said. Ms. Moore has been jailed in Camden County. A spokesman for the Georgia Public Defender Council confirmed that it is representing her but did not provide a further comment. The decision on whether to prosecute Ms. Moore is up to the district attorney, Keith Higgins.In a statement, the senior vice president of Pregnancy Justice, Dana Sussman, said, “No one should be criminalized for having an abortion.”However, an executive director of a group that opposes abortion, Georgia Life Alliance, Elizabeth Edmonds, said in a post on X that Ms. Moore is “not being charged for abortion.” She argued that the charges are related to the allegation that Ms. Moore took oxycodone.Court documents show that a toxicology screening detected oxycodone in the baby’s blood. However, police were told that the screening would not detect misoprostol. Since the Supreme Court overturned Roe v. Wade, there have been a few examples of women facing murder charges for obtaining an abortion. In 2022, a Texas woman was charged with murder for a “self-induced abortion,” but she sued the state, noting that the law states that women cannot be criminally charged for aborting pregnancies. And in January, a Kentucky woman was charged with fetal homicide and abuse of a corpse after she allegedly told a clinic she aborted her pregnancy and buried the body on her property.Lawmakers in some states have proposed bills that would criminalize abortion. A bill in Tennessee would have treated abortion as homicide, but it was defeated in committee.
