Gun Rights Debate Turns Topsy Turvy as Partisans Switch Sides Over Second Amendment Rights Following Killing by ICE in Minneapolis

After a protest at Minneapolis led to a deadly confrontation with ICE officers over the weekend, the dispute over gun rights is getting a role reversal as Democrats defend the deceased’s exercise of his Second Amendment rights while Trump administration and Republican officials insist those rights can be limited in circumstances such as those seen in Minneapolis. The debate took a twist Saturday after federal law enforcement officials killed a 37-year-old Veterans Affairs nurse, Alex Pretti, who was legally carrying a concealed Sig Sauer 9 mm gun at an anti-ICE immigration enforcement rally. Border Patrol officials say Pretti injected himself into the arrest of a woman along a commercial corridor that had been the site of multiple enforcement operations in the past several weeks. Six officers were tussling with Pretti at the time he was shot. Video shows that his gun had been removed from the waist or back pocket of his pants by a federal official before the shooting. Federal officials say he was resisting arrest and did not have his right-to-carry ID on him at the time of the shooting.Defending the police’s action, Trump administration officials said that Pretti should have been prepared for the consequences of coming to a rally with a semi-automatic pistol and two extra magazines on him. “You cannot bring a firearm, loaded, with multiple magazines to any sort of protest that you want. It’s that simple. You don’t have a right to break the law,” FBI Director Kash Patel said on Fox News’s “Sunday Morning Futures With Maria Bartiromo.”“The Trump administration does not believe in the 2nd Amendment. Good to know,” Governor Gavin Newsom of California responded after Mr. Patel’s statement.In Minnesota, legal carry can be both open or concealed. The state has strict rules limiting where a gun can be carried, including at schools and educational facilities, courthouse complexes, hospitals, child care centers, and certain government buildings, among other locations. However, it has no restrictions on carrying a pistol, with a valid permit, to a protest, demonstration, or political rally. The right to own a gun ranks high in America’s Bill of Rights, and conservatives and gun rights groups have traditionally hailed private individuals who have intervened with a gun to stop an attack. That was the case in 2025, when a volunteer security guard, Jay Trombley, and another private citizen shot and killed an attacker before he entered a sanctuary at CrossPointe Community Church in Wayne, Michigan, preventing mass casualties. It was also the situation in 2017 in Sutherland Springs, Texas, where Stephen Willeford was credited with stopping a mass shooter at First Baptist Church with his AR-15. The assailant died after a chase.But in the case of Pretti, administration officials have suggested he was violating the law. “There’s nothing wrong with anybody lawfully carrying firearms,” Deputy Attorney General Todd Blanche responded on “Meet the Press” to questions about Pretti’s actions at the rally. “But whether he was disarmed, or whether he pulled the gun on law enforcement, or whether law enforcement saw him go for the gun — what they have to do is protect themselves. They have to protect the public around them,” he added.Democrats point to the hypocrisy of accusing Pretti of planning an assault just for showing up with a weapon after many conservatives defended teen gun owner Kyle Rittenhouse, who was acquitted of multiple charges for killing two people and injuring another with his AR-15 after he was chased at a Wisconsin rally on racial justice in 2020. Mr. Rittenhouse surrendered to police when confronted.“How rich is it that (Homeland Security Secretary Kristi Noem) is saying showing up to the scene of a protest with a legally owned weapon should be grounds for a person’s death, execution at the hands of the state, by the same party and the same administration that praises Kyle Rittenhouse,” Congresswoman Alexandria Ocasio-Cortez of New York told CNN.After the incident, gun owner groups and some Republicans accused the administration of spinning itself into a fit to justify the shooting. Congressman Thomas Massie, a Republican from Kentucky who is frequently at odds with the administration, questioned whether the FBI can “just enforce the law without adopting every leftist gun banner talking point.” He pointed to the disconnect of saying that carrying a gun equates to bad intentions or that loaded guns, high-capacity rounds, and spare magazines are bad. “Carrying a firearm is not a death sentence, it’s a Constitutionally protected God-given right, and if you don’t understand this you have no business in law enforcement or government,” Mr. Massie said responding to an X post by U.S. Attorney Bill Essayli, who said there is a high likelihood that law enforcement are legally justified to shoot someone who approaches them while carrying a gun.“We’re now finding out which Republicans were simply cosplaying as Second Amendment defenders,” added former Republican lawmaker Justin Amash.
