ICE Agent Arrested in Texas Refuses To Return Voluntarily to Minnesota, Potentially Setting Up an Extradition Battle

An Immigration and Customs Enforcement agent facing charges in Minnesota, Christian Castro, will not waive extradition from Texas, setting up a potential legal battle over whether he will be sent back to the North Star State. Last week, Texas Rangers arrested Mr. Castro, acting on a nationwide arrest warrant issued by the Hennepin County Attorney’s Office. The charges stem from a January 14 incident in which Mr. Castro shot a Venezuelan man, Julio Cesar Sosa-Celis, in the leg. Mr. Castro alleged that he was attacked by Mr. Sosa-Celis and another man with a shovel and a broomstick. The Department of Homeland Security initially said the agent shot Mr. Sosa-Celis in self-defense. However, Minnesota law enforcement officials say video evidence contradicts that story. The Justice Department dropped charges against Mr. Sosa-Celis, and the DHS said it is investigating Mr. Castro’s statements.During a court appearance on Thursday, an attorney for Mr. Castro, Salvador Garcia, told a judge that his client will not waive extradition from Texas.Minnesota officials have hailed the arrest of Mr. Castro as an important step in their effort to prosecute him. But there are legal questions about whether they have legal grounds to prosecute a federal agent, and whether they will be able to get him back to Minnesota to stand trial. Mr. Castro’s refusal to voluntarily return to Minnesota adds a potential wrinkle to efforts to prosecute him. Minnesota Governor Tim Walz will have to send an extradition request to Texas Governor Greg Abbott. Extradition proceedings are fairly common and not controversial, with governors having limited discretion to reject such a request. The individual facing extradition typically has limited options to challenge their removal, such as if they are not the person who is named in the extradition warrant, or they believe officials lack probable cause. Minnesota officials said they are preparing to send extradition documents to Mr. Abbott, but it is unclear how he will handle the request. The governor’s office declined to comment on the matter. Mr. Castro was part of “Operation Metro Surge,” when thousands of federal agents were sent to Minnesota as part of the Trump Administration’s immigration crackdown. The DHS initially said that Mr. Castro was ambushed by men wielding a broom and a shovel in an attack that allegedly lasted three minutes. The two men, Mr. Sosa-Celis and Alfrado Aljorna, were charged with assault and resisting or impeding federal officers.However, the Justice Department dropped the charges in February as a video emerged that did not show the two men using a shovel to attack the ICE agent. The altercation also appeared to bThe Hennepin County Attorney, Mary Moriarty, has said that Mr. Castro fired a shot into Mr. Sosa-Celis’s home “knowing there were people who had just run inside who presented absolutely no threat to him or anyone else.” Minnesota officials have charged him with assault in the second degree and falsely reporting a crime. The DHS has slammed the charges against Mr. Castro, calling them “unlawful and nothing more than a political stunt.” A spokesman for the department told the Sun, “This is a federal issue, and it must be handled at the federal level.”Even if Mr. Abbott approves the extradition request, Minnesota officials will still face challenges to their case, as federal officers typically have broad immunity for actions taken as part of their official duties.
