In the Pied-à-Terre Tax Clash, Where Were the Adults?

Congratulations are in order for Judge Wayne Ozzi of New York’s supreme court for calling a halt to the campaign to tax pied-à-terre apartments in the city. The judge didn’t overturn outright the law at the center of Governor Kathy Hochul’s scheme to tax such homeowners; such an action wasn’t sought by the homeowner plaintiffs. The judge did make clear that the plaintiffs were harmed by the reckless rollout of the tax and that the city had to start over.If the ruling is upheld by higher courts, it would be a huge setback. The outstanding figure in this catastrophe, in our view, is Governor Hochul. It is she who moved to rush through the tax as part of the state budget process, without adequate vetting or even hearings at Albany. Not that Mayor Zohran Mamdani was innocent. He seems to evince an almost childlike infatuation with taxing the wealthy. Where, though, was the supposed adult in the room?In a separate lawsuit against the pied-à-terre tax, the former commerce secretary, Wilbur Ross, and resort mogul Stephen Wynn argue that the levy illegally discriminates against non-residents. This reflects legal reasoning that had led Mayor Bill de Blasio to refrain from imposing such a levy. The city worried over a Supreme Court precedent, Maryland v. Wynne, which rejected a state tax policy that treated differently the income of nonresidents’ and residents.’ The zeal of Mrs. Hochul, and Mr. Mamdani, to extract millions of dollars from the owners of second homes, Judge Ozzi found, seems to have led them to cut corners as they implemented the tax. Judge Ozzi’s ruling offers the prospect of relief for these homeowners, but likely only once the litigation is concluded. For now, the city has appealed Judge Ozzi’s ruling, which means that his decision will be automatically paused until higher courts can weigh the matter. Despite the lack of immediate solace for the homeowners, Judge Ozzi’s ruling amounts to a rebuke to Mrs. Hochul, Mr. Mamdani, and, more broadly, New York’s tax-and-spend Democratic regime. Judge Ozzi finds that, as a result of Hizzoner’s rush to impose the property levy, “homeowners are being substantially harmed and penalized needlessly” by the city department of finance’s “method of implementing the Tax Law.”Judge Ozzi holds, too, that forcing New Yorkers to scramble to get an “exemption” from the tax, the city’s “mailed notices irresponsibly and unnecessarily caused homeowners to expend time and money.” He invokes the specter, too, of “the irreparable harm of nonrecoverable compliance costs.” In contrast to these concrete injuries to property owners, a spokesman for Mr. Mamdani, Matt Rauschenbach, defends the tax on abstract grounds of “fairness.”Mr. Rauschenbach avers that “if you can afford a luxury second home in New York City, you can afford to pay your fair share for the schools, streets and parks that make this city work.” Yet this overlooks how owners of second homes are already paying taxes for city services that they tend not to use. This class warfare-inflected rhetoric ignores, too, the economic damage posed by the tax — including the reduction in incentives for new housing construction.That in turn helps to fuel the crisis of affordability that the mayor ostensibly wants to ameliorate. The nonpartisan Citizens Budget Commission, too, has warned that Mrs. Hochul’s levy “makes New York City less attractive to nonresident property owners who make important economic contributions that should not be overlooked.” Such policy flaws were not a factor in Judge Ozzi’s ruling, but they offer grounds for lawmakers to rethink this ill-advised tax.
