Luigi Mangione, Accused of Shooting UnitedHealthcare CEO, To Hear Ruling on Evidence Suppression Request

The man accused of murdering UnitedHealthcare CEO Brian Thompson, Luigi Mangione, is scheduled to appear at Manhattan Criminal Court on Monday morning to hear a judge’s ruling on the defense’s request to suppress key evidence in his upcoming trial.As he awaits a decision, federal prosecutors are asking a judge to reject as excessively intrusive the defense’s efforts to probe jurors’ personal lives.The 28-year-old Ivy League graduate, Mr. Mangione, is being prosecuted in three separate jurisdictions for crimes related to the killing of Thompson, who was gunned down on a Midtown Manhattan street in December 2024. He faces charges in Pennsylvania, where he was arrested; in New York state court, where the murder took place; and in federal court in the Southern District of New York for interstate stalking. Thompson, a 50-year-old father of two, who lived outside Minneapolis, was CEO of UnitedHealthcare, a major business division of UnitedHealth Group, one of the largest health insurance companies in the world. He had traveled to Manhattan to attend an investor conference at the New York Hilton. At approximately 6:45 a.m., he was shot from behind on the sidewalk and died about half an hour later at the hospital from the gunshot wounds. The suspect, caught on cameras wearing a hoodie and mask, fled the scene immediately, triggering a nationwide manhunt.Five days after the shooting, Mr. Mangione was arrested at a McDonald’s outside Altoona, a town in Blair County, Pennsylvania, about 270 miles west of New York. Defense attorneys argue that the officers unlawfully seized his backpack during the arrest and therefore contend that its contents should be suppressed from evidence in the upcoming trial. They also request that certain statements Mr. Mangione made during his arrest and subsequent interrogation be precluded. The evidence is considered crucial for the trial. Inside the backpack, officers allegedly found a 3D-printed gun, which investigators from the New York Police Department say matches shell casings recovered at the crime scene; a notebook containing handwritten notes that allegedly constitute a confession; and over $7,000 in cash.In December, New York Supreme Court Justice Gregory Carro held suppression hearings that lasted nearly three weeks and heard testimony from 17 witnesses, including several police officers from Altoona, Pennsylvania. Defense attorneys argued that Mr. Mangione was questioned for nearly 20 minutes without being read his Miranda rights and that his backpack was searched without a warrant.Prosecutors countered by questioning officers from the Altoona Police Department, who testified that a warrant was not required for the search because it was an “incident to arrest” search, which permits police to search a suspect and his belongings to ensure no weapons or explosives could endanger the public or arresting officers. The judge is expected to rule on the matter Monday morning. The case is scheduled to go to trial on September 8.While the Manhattan District Attorney’s Office has charged Mr. Mangione with second-degree murder and weapon-related offenses, federal prosecutors have accused him of two counts of interstate stalking, each carrying a maximum sentence of life imprisonment without parole. Defense attorneys raised similar requests in federal court to suppress evidence obtained from the backpack because the warrantless search violated Mr. Mangione’s due process rights.In January, District Judge Margaret Garnett denied the request. She held a one-day suppression hearing on testimony from Altoona’s deputy police chief, Nathan Snyder, who was not present during the arrest but provided general testimony about police protocols. Judge Garnett ultimately sided with the prosecution that the seizure of the backpack had not been conducted unlawfully. However, Judge Garnett granted the defense’s motion to dismiss two firearm counts in the indictment, including a death penalty-eligible charge, on legal technicalities.Although the federal case will not begin jury selection until October, both parties have already submitted questions for the jury questionnaire. On May 11, federal prosecutors filed a letter arguing that some questions proposed by the defense were “unnecessarily intrusive.” The questions have not been made public. Deputy U.S. Attorney Sean Buckley wrote in the letter that questions regarding the “ages, genders, occupations, and education histories” of the “children” of jury candidates are excessive. He also found inquiries about how often jury candidates “attend religious services” to be “inappropriate because a juror’s religious practices have no bearing on the juror’s fitness to serve.” Another question described as “overboard” concerned candidates’ “familiarity with heavily trafficked public areas and establishments in Midtown Manhattan.” “The relevant inquiry is whether a juror has any connection to the case, the parties, witnesses, or events that would impair impartiality — not whether the juror has visited or knows of a prominent Manhattan location,” Mr. Buckley wrote.The federal case will proceed after the state case. New York law provides strong protections against double jeopardy, preventing a defendant from being tried twice for the same crime. If federal prosecutors try Mr. Mangione first, defense attorneys may have a stronger argument to dismiss the state case on double jeopardy grounds.“If this case goes after the federal case, there likely will be no (state) case,” Assistant District Attorney Joel Seideman told the judge in February. Mr. Seideman emphasized the importance of a state trial, noting that the victim was a “guest of our city,” the murder occurred “on our streets,” and the New York Police Department “did all the work” in investigating the crime.During a Manhattan Criminal Court hearing in February, Mr. Mangione declared, “Same trial twice. One plus one is two. Double jeopardy by any commonsense definition.”Mr. Mangione, who has pleaded not guilty to all charges, is currently incarcerated at the Metropolitan Detention Center at Brooklyn. The federal judge is allowing him to appear at Monday’s hearing in civilian clothing rather than beige prison garb. He will be permitted to wear a suit, shirt, socks, and shoes without laces.The hearing is set to begin at 9 a.m. ET.
