New York Agrees To Stop Trying To Force Nuns and Religious Organizations To Pay for Abortions

A group of Catholic nuns and other religious organizations in New York secured a legal victory as the Empire State is vowing to stop trying to force religious entities that serve people of any faith, or none at all, to cover abortions in their health care plans. On Tuesday, the Becket Fund, which represented a group of religious organizations in their challenge of New York’s mandate, said that the state reached a settlement to grant the entities an exemption. In 2017, New York’s Department of Financial Services required all employers in the state to cover abortion in their health plans. The state initially provided an exemption to the mandate for religious employers, but later limited it to religious organizations that primarily employ and serve people of their own faith.A group of Catholic organizations — including the Diocese of Albany, an order of goat-herding nuns, and Baptist and Lutheran churches — sued to challenge the rule to secure an exemption for organizations that provide services to people outside of their faith. In 2024, New York’s Court of Appeals unanimously upheld the mandate. The chief judge, Rowan Wilson, said that the requirement “differentiates between religious and non-religious entities.”“For example, a person having two part-time jobs, one cleaning the floors of a Catholic church and one cleaning the floors of a soup kitchen run by a Catholic charity that serves all people, may be entitled to obtain insurance covering medically necessary abortions from one but not the other,” Judge Wilson wrote. “Nothing about that situation disfavors any religion based on its beliefs; it differentiates between employers and the type of entity.”However, last spring, the U.S. Supreme Court directed New York courts to reconsider the case in light of its ruling in Catholic Charities Bureau v. Wisconsin Labor and Industry Review Commission. In that decision, the high court ruled that Wisconsin could not exclude Catholic Charities from a tax exemption because the organization did not proselytize or engage in what the state considered “typical” religious activities.A senior counsel at Becket, Lori Windham, said in a statement, “For nearly a decade, New York bureaucrats tried to strong-arm nuns into paying for abortions because they serve all those in need.”“At long last, the state has given up its disgraceful campaign. This victory confirms that the government cannot punish religious ministries for living out their faith by serving everyone,” Ms. Windham said. “The Supreme Court has made it abundantly clear that religious groups shouldn’t be bullied for staying true to their faith. We are glad that New York finally agreed to settle this case and protect religious objectors from discrimination.”New York’s Department of Financial Services did not respond to The New York Sun’s request for comment by the time of publication. The decision to settle the case comes as a separate Catholic ministry, the Little Sisters of the Poor, is appealing a ruling by a federal court that requires them to offer employer-sponsored healthcare plans covering contraceptives — despite the nuns winning two cases at the Supreme Court in the decade-long dispute.The Supreme Court has twice ruled in favor of the nuns. In 2016, the justices said that the government should “arrive at an approach going forward that accommodates the petitioners’ religious beliefs.” And in 2020, the court upheld an exemption to the mandate created by the Trump Administration.However, Pennsylvania and New Jersey brought a procedural challenge to the exemption, arguing that it violates the Administrative Procedure Act, an issue in the case which the Supreme Court has not yet addressed.In August, a federal district court judge, Wendy Beetlestone, an appointee of President Obama, issued an injunction, blocking the exemption, finding that it was “arbitrary and capricious” and that the federal government had shown “no adequate justification.”
