The Embryo Nobody Conceived, and the Law That Never Saw It Coming

In a laboratory dish, ordinary human stem cells sit in a chemical bath, no sperm involved, no egg, no act of conception. Left alone, a small fraction do something researchers still find hard to believe: they begin to sort themselves by type, cluster together, and build.A yolk sac takes shape. An outer layer destined to become a placenta wraps around the rest. Two weeks in, the cluster has arranged itself, component by component, into something that looks remarkably like an embryo freshly lodged in a womb, and it secretes the hormone that turns a pregnancy test positive. Nothing here was conceived. It was constructed.Earlier this year, a sprawling group of the world’s leading developmental biologists did something rare for a field running at full tilt. Led by Dr. Alfonso Martinez Arias of Pompeu Fabra University in Barcelona and co-signed by more than 40 researchers spanning a dozen countries, they published a white paper, “Human Stem Cell-Based Embryo Models: Innovation, Ethics, and Policy,” in the journal Human Reproduction, calling for the rules they themselves have been working without.It leaves the law facing a question it has no answer for: at what point does a replica of a human embryo stop being a replica?Lifelike, but Not AliveThese are not science fiction props. Over the past few years, researchers have coaxed ordinary stem cells into clusters that, left to their own devices, organize themselves and behave for several days much like an embryo just settling into the womb. They were not conceived. They cannot, at least not yet, grow into a baby. They live out their brief existence in dishes and bioreactors.Yet they look and act enough like the real thing that ethicists, lawmakers, and pro-life advocates warn that the United States has built almost no fence around the work.At the Weizmann Institute of Science, located in Rehovot, Israel, just south of Tel Aviv, one team grew models complete with the beginnings of a placenta and yolk sac, reaching a stage equivalent to a natural embryo around day fourteen. At Cambridge and the California Institute of Technology, rival groups captured later development.Some of the models have grown lifelike enough to secrete the hormone that turns a pregnancy test positive. For decades, the opening weeks of human pregnancy were nearly impossible to study, the gap in scientific knowledge sitting precisely where most pregnancies quietly fail.The potential rewards are vast. Infertility affects an estimated 186 million people worldwide, and IVF success rates still hover around 25 percent. These models could crack open the black box of why implantation fails, why chromosomes go wrong, and why so many pregnancies end before a woman even knows she is pregnant — roughly 23 million miscarriages occur globally each year.They also offer a window for testing drugs during the most dangerous developmental window without putting a single real embryo, or a mother, at risk. The concerns, however, are equally serious. The closer a model comes to the real thing, the harder it gets to argue it deserves no legal protection.The white paper flags three categories of worry: whether a model could, if implanted, develop into a person; whether features like a forming hand or a beating heart carry their own moral weight regardless; and whether a model could eventually develop a nervous system capable of feeling pain.None of those questions has a settled answer, and each one raises the stakes further. A companion analysis published in Nature Cell Biology this April, co-authored by Dr. Martinez Arias, urged the scientific community to run every model through all three tests before the work proceeds.For now, no regulator in the United States has the authority to require anyone to do so. Federal law restricts funding under the Dickey-Wicker Amendment while leaving privately financed research entirely untouched. Still, the scientists doing the work caution against confusing imitation with the genuine article.“As of now, there is no scientific evidence which supports human embryo models as being equivalent to human embryos,” the director of the UCLA Center for Reproductive Science, Health and Education and a professor of molecular, cell and developmental biology, Amander Clark, tells the New York Sun. “In many cases these structures only model aspects of early human development and would not be viable beyond a few days.”The Rules Never Imagined ThisThe trouble is that the legal map, in the United States, Britain, and much of the world, was drawn for a different world. The fourteen-day convention barring researchers from culturing a human embryo beyond two weeks dates to a 1979 American federal advisory board, endorsed by the United Kingdom’s Warnock Committee in 1984, long before anyone could conjure an embryo-like entity from skin or blood cells.In 2021, the International Society for Stem Cell Research, the industry’s influential professional body, relaxed that limit for ordinary embryos and ruled it did not apply to stem cell models at all, leaving oversight to individual institutions on a case-by-case basis.The United States has no federal law that directly restricts this research. The main brake on the science is a ban on federal funding, which private money easily bypasses. Britain, long a leader in this corner of biology, got as far as a voluntary code of practice in 2024 — considered guidance with no teeth. The Nuffield Council on Bioethics has since pushed Parliament to go further, calling for hard legal limits including an outright ban on transferring any such model into a human or animal womb.Ask Professor Hank Greely of Stanford what actually stops an American lab from building these models and letting them run, and his answer is short: “Nothing, as far as I can see.””There are guidelines from the stem cell society, he tells the Sun, “but they are guidelines and do not have the force of law.”In plain terms, that means any well-funded private lab in America can build these models today and face no legal consequence for doing so. However, the funding squeeze is real, even where the law is silent.“There is no law preventing this research, but there seem to be stringent criteria on the side of Federal funding,” Dr. Martinez Arias tells the Sun. “Researchers have to turn to private funding.”That matters because private money answers to no federal ethics board and faces no binding oversight — a congressional office noted decades ago that there is “no oversight of the private sector” in this space, a gap that has never been closed. A startup or a billionaire-backed lab operating outside a university can push the science as far as it wishes, with only voluntary guidelines standing between a petri dish and a model indistinguishable from the real thing.Some scientists think the voluntary system is not enough. A separate proposal in the journal Cell this year lays out a two-tier system built around one non-negotiable: no model should ever reach the point where it can feel pain. The practical cutoff they propose is day twenty-eight, when the neural tube closes, the moment they say should trigger serious scrutiny for any experiment pushing past it.By day twenty-eight, a developing embryo has begun forming the earliest foundations of a brain and spinal cord, and these scientists argue that is the moment a lab-grown model tips from biology experiment into something that demands far closer watching.Where the Alarm Is LoudestBetter models lead to uglier questions. There is a line between imitation and replication in a seminar room, yet this line disappears in a real-world dish.Still, Dr. Arias, for his part, thinks that day is distant.“The answer is far,” he says of how close anyone has come to a model indistinguishable from a human embryo. “I am not optimistic about the ‘creation’ of a human embryo with recognizable human features for a long time.”Some models reach the start of gastrulation, the process that lays down the body plan, “but then fail,” he explains, adding that “there is no hint that a whole embryo with human characteristics is around the corner.”The researchers who build the models push back on the idea that they are splitting hairs to avoid a harder conversation.“The large majority of ethicists, researchers, and policymakers currently agree that these models should not be treated as embryos. They do not originate from the fusion of sperm and oocyte, they are not part of a parental project, and they cannot develop efficiently or faithfully beyond a few days in vitro,” a principal investigator at the Institute of Molecular Biotechnology of the Austrian Academy of Sciences, Nicolas Rivron, tells the Sun.“These are meaningful and principled distinctions, not convenient ones.”For those who believe human life begins at conception, however, the line was crossed the moment a model resembling an embryo took shape in a dish. The Charlotte Lozier Institute, the research arm of a prominent pro-life group, has pressed the country to abandon the fourteen-day convention in favor of a far stricter standard, casting the work as the reduction of nascent human beings to laboratory supplies.Money, meanwhile, is moving faster than the regulators. A growing field of companies is racing to commercialize the science, from startups hoping to harvest youthful replacement cells from embryo models to firms placing models on uterine tissue to study how pregnancy takes hold. Patent offices on both sides of the Atlantic are fielding a flood of claims over the new entities.The commercial pull is straightforward: the potential market for therapies derived from this science runs into the tens of billions of dollars. Aging populations need replacement tissues and organs. Infertile couples need better IVF outcomes. Drug companies need safer ways to test compounds on human tissue before they reach patients.Stem cell embryo models, if the science holds, could answer all three at once — which is why Renewal Bio, a startup co-founded by the Weizmann Institute’s Professor Jacob Hanna, is pursuing embryo models as a source of replacement cells to treat aging and disease, and why European firm Dawn Bio has begun placing model embryos on uterine tissue to unlock insights into why IVF so often fails.Where there is that much money and that much human need, experts fear, the science will likely not wait for the law.For Mr. Greely, that darker chapter is the nightmare worth naming. He doubts any reputable institution would attempt it, yet he cannot dismiss a lone operator chasing fame in a small laboratory somewhere in the world.The danger, he underscores, is that “some fool will try to use them to make babies without nearly sufficient work to show reasonable safety.”“(This could) lead to miscarried fetuses, stillborn babies, or babies with several disabilities,” Mr. Greely adds. “That would be damnable.”
