Trump’s Deportations: Time Is of the Essence

President Trump’s push to deport illegal immigrants is intensifying, but some federal judges seem intent on throwing a spanner into the works. The pace of arrests of illegals has doubled to some 2,000 a day, per the Times, as Mr. Trump seeks to address the influx of millions of border-crossers under President Biden’s lax supervision. Yet federal courts, by insisting that illegals are entitled to bail during deportation proceedings, risk slowing removals to a crawl.This question, centering on what due process rights illegals have under the law, is shaping up as one that the Supreme Court will need to resolve. This is underscored by what’s known in legal parlance as a circuit split. That’s judicial jargon for when federal appeals courts come to different conclusions on the same disputed question. In the case of whether illegals are entitled to bail, riders on the Second, Fifth, Sixth, Eighth, and 11th Circuits are at odds.With the appellate bench apparently riven by this question, Mr. Trump’s solicitor general, John Sauer, is turning to the Supreme Court for guidance. The dispute involves “a critically important question of immigration law that has divided the courts of appeals,” General Sauer writes in his petition to the high court: Whether illegal immigrants “must be detained while their removal proceedings unfold” or whether the illegals can be released on bail.The administration’s approach on this matter is grounded in federal law, General Sauer asserts, and has a common-sense rationale. “Detaining aliens who are living in the country after an illegal entry while their removal proceedings unfold prevents those aliens from evading hearings and helps ensure their removal,” he avers. Denial of bail “also eliminates a perverse incentive for further illegal entry,” he adds, by keeping migrants from “benefiting from illegal entry.”General Sauer warns that the legal hurdles imposed by federal judges in deportation cases “will continue to impose immense burdens on district courts and U.S. Attorney’s Offices throughout the nation until this issue is resolved.” As of this writing, there’s no indication from the high court as to the disposition of General Sauer’s request, made on June 26. It would prove regrettable if the justices’ summer vacation delays action on this question.The surge in arrests of illegals, the Times says, suggests a renewed effort by Mr. Trump “to meet his pledge of mass deportations,” a policy “popular among his conservative supporters” but one that has led to “a political backlash” over “heavy-handed tactics.” These columns have marked the point that, because America needs a growing labor force, legal migration should be fostered even as laws against illegal border-crossing should be enforced.As General Sauer points out, enforcing the border implies strict treatment for illegals when they are identified by federal authorities. Yet some judges are drawing a distinction between migrants apprehended near the border and those who are found in the interior of the country, and who even have been living here for years. Past Supreme Court precedents suggest that illegals who have put down roots in America are entitled to more due process rights.A subtext in this legal wrangling is the matter of “Time’s winged chariot hurrying near.” Mr. Trump is approaching the midpoint of his term, with no guarantee that his successor in the White House will maintain his policy of border control, much less deporting illegals already here. Judicial deliberations in deportation disputes proceed slowly. Yet when it comes to Mr. Trump’s efforts to fulfill his campaign vows on immigration, time is of the essence.
