Mangione Expected To Plead Guilty in Federal Case: Reports

Luigi Mangione is expected to plead guilty in federal court on Friday for gunning down UnitedHealthcare CEO Brian Thompson in December 2024, federal sources revealed to several news outlets on Thursday.The New York Sun reported on Wednesday that a sudden conference was scheduled in his federal case for Friday, raising speculation that a plea deal could be in the works.It remains unclear if Mr. Mangione will choose to enter an open plea, opting out of a sentencing deal with the government and instead argue for a milder sentence before the judge. The defendant can still change his mind on Friday and not enter a plea at all, as the final decision rests entirely with him. “Open pleas are rare,” a criminal defense attorney, Elena Fast, told the Sun on Thursday. “But we have seen them in our practice. The benefits of pleading open are you keep your appellate rights.” TMZ reported on Wednesday that Mr. Mangione could possibly enter a so-called open plea, also known as a “plea straight to the bench,” in which case he would skip negotiating an agreement with the government. Both parties would then present arguments to the judge during a sentencing hearing. The defense could ask for leniency based on mitigating factors, such as mental health issues, while the prosecution could push for a harsher punishment. Federal prosecutors have charged Mr. Mangione with two counts of interstate stalking that resulted in the death of a person. The maximum sentence for a conviction is life in prison. The federal system does not permit parole. “No one can predict a sentence at this point because sentences are unpredictable,” Ms. Fast wrote in an email to the Sun. She explained that the presiding district judge, Margaret Garnett, would calculate U.S. Sentencing Guidelines according to a points system. “You get points off for acceptance of responsibility (either 2 or 3 points), which you would not get with going to trial,” Ms. Fast explained. But the judge could arrive at a sentence that differs significantly from the guidelines. “Guidelines are just the starting point of the judicial analysis,” she said. Mr. Mangione could still be sentenced to life, even if he enters an open plea. The 28-year-old Baltimore native also faces second-degree murder charges and weapon offenses in a separate case in New York state court, which is currently scheduled for trial on September 8.He is being prosecuted in two jurisdictions, the Manhattan Criminal Court and the U.S. District Court for the Southern District of New York, for the same crime: the assassination of Thompson, who was fatally shot on a Manhattan sidewalk in the early hours of December 4, 2024.The 50-year-old father of two children had traveled to New York from Minnesota where he resided to attend an annual investor conference at the Hilton Hotel. The killer, who was caught on surveillance cameras, approached him from behind and shot him first in the leg and then in the back. Thompson died at the hospital about 30 minutes after the shooting. The assassin fled the scene immediately. Investigators later recovered live rounds and casings featuring the words “delay,” “depose,” and “defend.” After a five-day manhunt, Mr. Mangione was arrested at a McDonald’s at Altoona, Pennsylvania, about 270 miles west of New York City. He was extradited to New York and has been held at Metropolitan Detention Center, a federal jail in Brooklyn, ever since. Up until now, he has pleaded not guilty to all counts, but that could change on Friday.“Usually, open pleas are done when the client cannot prevail at trial and the prosecution’s plea offer, along with the appellate waiver, represents the greater of two evils,” Ms. Fast said.The evidence in this case is significant. According to investigators, Mr. Mangione’s fingerprints were matched to those on a discarded water bottle and a Kind bar wrapper found at the crime scene. Furthermore, shell casings of the bullets match the ghost gun he carried in his backpack when he was arrested in Pennsylvania. Even more incriminating is the red notebook he had with him, which contains disparaging writing against the healthcare industry and thus provides a clear motive.“This could be a very clever strategic move,” Ms. Fast said. “Plead openly with the court, keep your appellate rights, and then potentially have an argument that the state prosecution cannot proceed because of double jeopardy.”New York State has strict laws to protect against double jeopardy and prevent a defendant from being tried and punished twice for the exact same crime. In order to raise a double jeopardy argument before the state judge, however, the federal prosecution must either have sworn in a jury for trial or have ended in a conviction by a guilty plea. Once Mr. Mangione enters a plea, his defense attorneys can try to get the state case dismissed. In early July, after rumors about plea deal negotiations first surfaced in the media, state prosecutor Joel Seidemann sent a letter to Judge Garnett that his team was “aware of public reporting regarding the possibility of a guilty plea in defendant’s federal case.” Mr. Seidemann asked Judge Garnett to consider Thompson’s family and to be mindful that the defense may use the plea deal as a maneuver to get out of the murder charge in the state case.“If a proposed federal guilty plea would operate to defeat a just outcome in the state prosecution,” the prosecutor warned, “the People could advise the federal district court of that consequence, and the court should consider that fact in deciding whether to accept the plea, as well as any opposition by the victim’s family to such a resolution.”State prosecutors could counter the double jeopardy claim by arguing that the murder case falls under an exception because the statutory provisions address entirely different offenses, stalking versus murder. The final decision on whether the state trial proceeds rests with New York Supreme Court Justice Gregory Carro.An independent criminal defense attorney based in Baltimore, Tom Maronick, who also spoke to the Sun on Thursday, was not surprised to hear about the expected plea deal. Mr. Maronick hosted a law and politics talk show on a conservative Baltimore radio station owned by the Mangione family, but is not a consultant for Mr. Mangione or the prosecution. “Well, the tip off was when they were exploring different other defenses, including mental health, and then they pulled it back,” Mr. Maronick said. In mid-June, defense attorneys announced during a hearing in state court that they would pursue an “affirmative psychiatric defense,” and claim their client suffered from an “extreme emotional disturbance” at the time of the crime. But two days later, the defense withdrew their notice. “That’s not normally something you do if it’s going to go to trial,” Mr. Maronick said. “So, I sort of had a tip off that this (plea deal) would be in the realm of possibilities, but I didn’t know for sure.”
